Research On Scope Of Protection Of Patent Right For GUI Design Patent

As the rapid development of internet industry and electronic industry in China,more efficient and convenient new products are put into market,which introduces a new industry,GUI design industry.In GUI design industry,there is a severe problem,copying of GUI design.For fulfilling the demand of protection for GUI design,GUI design is included in the design patent of China in 2014.The protection for GUI design patent in China is just at beginning stage,so research and accumulation among the academic circles and judicial practice are inadequate.The scope of protection for GUI design can't fulfill the demand of GUI industry,especially without part of design system,the scope of protection for GUI design does not apply to GUI design.This thesis tries to study design system applied to GUI design of China from following three parts below:Firstly,this thesis introduces the confirmation of scope of protection for GUI design and design system in China,EU,USA and Japan,and concludes the characters of design system in China,EU,USA and Japan,and draws out inspiration from foreign GUI design system for China's GUI design system.Secondly,for study of the confirmation of scope of protection for GUI design upon China's GUI design system,this thesis analyses the prosecution and judgment of design patent with the characters of GUI and draw out some flaws in the confirmation of scope of protection for GUI design.Thirdly,some standpoints on the characters of confirmation of scope of protection for GUI design,like color,changeable GUI and normal consumer,are drew out on the basis of foreign GUI design system.
