Study On The Nature And Application Of Law Of Online Reward Contract

The online reward contract,which is called “rewarding” contracts and“appreciating” contracts in the field of network economy,is a form of contract that has been widely found in judicial practice in the context of the emerging profit model of the network.In order to solve the controversy caused by the vagueness of the network rewarding contract in the current legal theory and judicial practice,this paper studies the legal nature and legal application of the online reward contract.The first part of this paper introduces the related concepts of online reward contracts,discusses its origin and evolution,concept,classification,characteristics,formation process and main terms,clarifies the scope of online reward contracts,and determines the research object of this paper.The second part is in China.Within the current legal framework,according to the judgment method of the nature of the contract,the online reward contract and the gift contract,the sales contract are compared and analyzed from the perspective of legal definition,contract target and main features,so as to judge the nature of the network reward contract and The conclusion is drawn.The third part discusses the legal application of the online reward contract.Firstly,on the basis of explaining the influence of the nature of the contract on the application of the law,the legal application rules of such contracts are obtained,and then the nature of the contract is rewarded according to the article.The conclusion is determined,and the basis and possibility of the rights of the contracting parties to exercise the right of revocation,rescission,and property restitution of the contract are analyzed.In addition,suggestions are also made for the legal regulation and benign development of the network reward contract.The conclusion part summarizes the innovations and shortcomings of this paper,and looks forward to the future research.
