The law is an important tool of a country.According to the provisions of the Constitution of the People's Republic of China,the procuratorial organs are state organs for legal supervision to exercise procuratorial power on behalf of the state by law,to ensure the law applicable and standard,and to safeguard social fairness and justice.According to the Procurator Law of the People's Republic of China,the procurators are the procuratorial personnel to exercise the procuratorial power of the state by law and the main body to exercise the procuratorial power.In the context of current reform of the judicial system,to build and improve a set of sound performance appraisal methods and establish a scientific and reasonable performance appraisal system by applying a series of quantizable and operable performance appraisal indexes on the procurators' identity characteristics and professional attributes can not only objectively and justly assess and evaluate procurators' work,but also effectively relieve the issue of fair allocation of salary caused by the different quantities,qualities and results of cases,meanwhile,can also fully mobilize their enthusiasm and initiative in work,ensure the qualities and results of cases,prompt the implementation of the procurators' case responsibility system,promote the fair and just law enforcement,and improve the organic unity of law effect and social effect.According to the unified arrangement and deployment of the central government,the reform of the judicial system,focusing on the reform of the judicial responsibility system,kicked off in 2013 and was started in Shanghai,Guangdong,Jilin,Hubei,Hainan,Qinghai and Guizhou as a trial in December,2014.At the end of 2015,a nationwide trial of the reform of the judicial system was carried out,and Gansu was in the list.In June,2016,Tianshui city,as a first batch of pilot zone of the reform of the judicial system of procuratorial organs in Gansu province,started the reform of organs,personnel and judicial responsibility system in the municipal and prefectural procuratorial organs.Especially in the aspect of personnel reform,personnel in the procuratorial organs were classified into procurators,auxiliary procuratorial personnel and judicial administrative staff for management,where,as procurators were the core of procuratorial power after the reform,the system specified number of personnel was implemented to strictly put the lifetime responsibility system of case quality and the accountability system of misjudged case while highlighting the function of handling a case.Meanwhile,a supporting bonus which takes procurators as the core was generated thereby.Procurators were promoted by individual post and paid according to their performances,so their salaries were improved significantly.After the procurators' powers have been concentrated and their salaries have been improved,how to scientifically manage procurators has become an important premise to realize the target of procuratorial work.Therefore,under the new situation of the reform of judicial system,it is of great significance to further improve procurator management mode and to form a set of procurator performance appraisal system of prominent functions,accurate positioning and easy running.This paper adopts such research methods as literature research,concentrated interview and questionnaire.First of all,it expounds the purpose and significance of research,research status at home and abroad,and the research approach and innovative points of this paper,and explains relative concepts.Secondly,it introduces the status and operational results of procurator performance appraisal in Tianshui city,mainly including the goal positioning,main body and mode,indexes and grades,as well as the application of appraisal feedbacks and results of the performance appraisal system.After the acquaintance with contents mentioned above and through the combination of status of procurator team in Tianshui city,it analyzes the problems existing in current procurator performance appraisal system in Tianshui city,which mainly lie in inaccurate goal positioning,single main body and unreasonable indexes of appraisal and lagged application of appraisal feedbacks and results.It also analyzes the causes of the problems,by combining related issues,mainly to include differential appraisal theory,low degree of participation,unclear functions of procuratorial post,poor communication channel and the disconnection between results and rewards and punishments.Thirdly,on the basis of analyzing the causes of the problems,and comparing with the contents of performance appraisal system of civil servants and procurators at home and abroad,it looks for gaps and parts worth learning from.And finally,through applying related theoretical basis for performance appraisal of public administration department and combining with actual procurator performance appraisal in Tianshui city in the context of judicial reform,it proposes the goal,principle and frame to improve procurator performance appraisal system,with Delphi method,the application of balanced scorecard and the combination of actual procuratorial organs,designs indexes of performance appraisal and establishes the BSC-AHP-based index weight of procurator performance appraisal,and analyzes and proves the feasibility of this index weight from existing environmental conditions.
