Research On The Relief System Of Urban Housing Expropriation Compensation

The compensation relief system of urban housing expropriation refers to a system in which the injured party restores their rights and interests through legal provisions or approved measures when the expropriated person of urban housing cannot receive reasonable compensation.Nowadays,the legal provisions on compensation are not perfect,which leads to the difficulty of parties seeking relief after the disputes of compensation for levy occur.Even if the administrative organ accepts the party's application for reconsideration and the court accepts the party's request for administrative action,it may not guarantee that the contradiction will be resolved.Therefore,it is urgent to reform and improve the relevant rights protection system.Under the background of the promulgation of the Regulations on Housing Expropriation and Compensation on State-owned Land and the implementation of the newly revised Administrative Procedure Law of the People's Republic of China,although some problems in urban housing expropriation have been solved,the right of fair compensation of the expropriated still needs to be fully guaranteed.The right should be relieved,and the right should be relieved effectively.Aiming at perfecting the relief system,the defects of various relief ways in China are displayed.Introducing the successful experience of advanced countries ruled by law,we can build a more complete and diversified dispute settlement system.Strengthen the protection status of the rights and interests of the lessee and other related persons,and strengthen the protection of the right to know,the right to participate and other rights.Starting from three relief types of administrative mediation,administrative reconsideration and administrative litigation,this paper introduces the current situation,problems and improvement measures in the field of housing expropriation compensation relief.At the same time of realizing the public interest,this paper studies and designs the construction of a perfect compensation and relief system for urban housing expropriation.Give full consideration to the legitimate rights and interests of the expropriated and other stakeholders,and give them fair and reasonable compensation.
