Research On Legal Promotion Of Wind Power Generation In China

In the 1980 s,wind power rose in China.In 2010,the number of wind power installed in China reached the first in the world.In recent years,the scale of wind power market in China has increased year by year.However,the situation of abandoning wind and limiting electricity is still grim.In order to promote the development of wind power industry,China has promulgated a series of laws with Renewable Energy Law as the core,and has also formulated laws such asThe total target system,the full guaranteed acquisition system and the corresponding economic incentive system,but the abandonment rate has always been high.Based on the analysis of relevant legal theories,this paper holds that the legal problems behind the problem of "abandoning wind" are as follows: the legislation is scattered,the legal level is low,the total amount target system is lack of foresight,and the full guaranteed acquisition system is not perfect.The economic incentive system to promote the development of wind power is not perfect,and the mechanism of electricity price addition and subsidy is not perfect.Through the analysis of the above problems,it is inferred that the main reasons for the above legal problems are the lack of overall system design in the formulation of laws,the game of interests between the central government and local governments,as well as between the government and enterprises.By drawing lessons from the relevant experience of developed countries,such as the long-term economic incentive system in the United States,Germany's wind power biddingThe competitive bidding system and the Spanish wind power product price subsidy system,etc.,in view of the legal promotion of wind power generation in China,the following suggestions are made: improve the energy legal system and fully implement the full guaranteed acquisition system.We should perfect the economic incentive measures for wind power industry,strengthen the subsidy system of wind power industry,perfect the quota system of wind power generation,and introduce the market competition mechanism.
