Research On Legal Issues Of International Education Service Trade Under GATS Framework

The international education service trade is an important part of the GATS service trade framework.The market of education service trade in China has great potential,and it also faces many challenges as a developing country.At present,China’s commitment to education service trade is still reserved in some areas,which is basically based on the reality of national conditions.But at the same time we also want to look to the future,on the premise of guarantee sovereignty of national education,through policy loan and the legal safeguard,the education service of our country in the international education service market more competitive.This paper analyzes the legal characteristics and development of education service trade power mode,actively absorb can be drawn lessons from their experience,combined with the development of our country,the elaboration full existing in our country’s education service trade laws,in order to ensure the stable development of education service trade market in our country.Since China joined the WTO,it has entered the market category of international education service trade,and has also caused China education to collide with the world education.Since the development of education service trade in China,we haveexperienced the beginning and development stage,and now face more challenges in a more integrated global environment.It is understood that China’s education service trade related laws and regulations,the policy guarantee is in the initial stage,not perfect.And analysis of education service trade articles and books,from the aspects of economy,trade,education,etc,the author prepared from legal Angle to analyze problems,find out the problem of the lack of laws and regulations and education services.The first part,the author is divided into two parts,first in this paper,the object is analyzed in this paper,the first is the basic concept of education service trade characteristics and academic circles of the existing related theory,such as comparative advantage theory,public choice theory,etc.Followed by the legal standard of education service trade,which provide education service trade mode,principle and exception,enumerates the trade in services provide four ways in education service trade.The second part is the analysis of the legal regulation of the representative education service developed countries,including the UK,us and Australia,and summarizes their respective characteristics and advantages.The third part respectively from the way it offers four kinds of education service trade Angle has analyzed our country education service trade legal issues of market access and national treatment.Analyze the existing commitments of our country in these four ways to meet the needs of development and summarize the problems.The fourth part mainly puts forward the education service trade supervision mechanism of legal issues,this paper introduces the education service trade of our country’s existing regulators and regulatory mode,and put forward the education service trade regulators set Suggestions,establish wide coverage,professional and strong,large regulation as the leading factor of government departments,social organizations as the auxiliary regulator,regulatory system,combined with unified regulatory standards,regulation on irregularities in the industry.The fifth part is the analysis of the status quo of China’s international education service trade laws and improvement Suggestions,first discusses the education service trade in the WTO and legal status,which includes the contradiction between the for-profit education public welfare and education service trade,the lagging of the law and the lack of early warning mechanism;Secondly,put forward to build the perfect Chinese education service trade laws and regulations system of the suggestion,publish relevant laws and regulations,and perfect the supervision mechanism,establish an early warning system for the law at the same time to strengthen international cooperation of trade barriers.In this paper,from the Angle of law,analyses the problems existing in the education service trade in China,mainly including education service trade market access and national treatment and the perfection of supervision mechanism two big problems,respectively from four angles analyze our country education service trade commitments table with the domestic law of contradiction or missing;It also puts forward detailed Suggestions on the ownership of the supervision right of education service trade and the establishment of the regulatory system,aiming at providing a kind of help for the improvement of the legal system of education service trade in China.
