The special working-hour system is a system established by labor law that is different from standard working-hour and has been in operation for almost 24 years.At present,basically formed around the standard working-hour as the main body,and special working-hour as supplement body.Special working-hour management of government departments restrict the behavior of enterprises,through a series of procedures such as rulemaking,examination and approval of enterprises applying for special working-hour,supervision and inspection of the implementation of approved enterprises.The effectiveness of the government’s administration of special working-hour directly determines the realization of the right to rest and remuneration for workers.Due to its flexibility and reduction of labor costs,enterprises are required to apply for special working-hour to government departments.It put forward higher requirements for government departments to safeguard the legitimate rights and interests of laborers.In 1994,China formulated the first independent < approval regulation on irregular working-hour and integrated comprehensive working-hour >,which marks the start of the special working-hour management in our country.According to the actual situation all over the country,they have formulated different regulations on approval procedures.Up till now,the national legislation concerning themanagement of special working-hour has not been issued yet.<Approval regulation on irregular working-hour and integrated comprehensive working-hour> have lagged behind in time and the contents also contain only one item for approval,it brings great difficult of goverenmental management on special working-hour With the promotion of the interests of enterprises,due to special working-hour caused more overtime wage disputes,affecting the harmonious construction of labor relations.It is the starting point of this study that how the government manages the application and implementation of special working-hour and promotes the flexible employment of workers while protecting the rights and interests of laborers.This paper first introduces the concepts of the standard working-hour,special working-hour,special working-hour management.Secondly,by reviewing the history of special working-hour,the special working-hour management in Shanghai,the status of special working-hour approval in Q-district,and the questionnaire and interview on the evaluation of special working-hour management in Q-district,the author analyzes the problems and reasons of government in special working-hour management.Finally,according to the actual situation of the special working-hour management,the author analyzes the countermeasures to perfect the special working-hour management work,mainly focusing on the improvement of the legal system,the enhancement of the regulatory approval,the strengthening of supervision and inspection,the establishment of a variety of training publicity system,and the enrichment of special working-hour management personnel.These measures are intended to improve the administration of special working-hour at all levels of government.The government takes the responsibility of not only giving special enterprises the flexibility to arrange working hours but also protecting the legitimate rights and interests of workers,in order to promote the harmonious development of labor relations in our country.
