Chinese Judge Assistant System Research

As a new round of judicial system reform,the court,as an important part of the judicial system,launched a comprehensive reform from top to bottom,and the assistant system of judges was once again put on the agenda.A judge assistant is a support person who assists the judge in the trial business.Judge assistants were first implemented in the United States and later cited by most countries.In the 1999 Reform Outline of the Supreme People’s Court of China,it was stipulated that the trial assistants system should be tried and the history of the judges’ assistant system in China should be reviewed.There are successes and failures,and years of practice have accumulated valuable experience.The provision of appropriate assistants for judges is a practice in most countries and an integral part of the modernization of the courts.The important period of the judges’ assistant system reform and the reform of the court staff classification management play an important role.The establishment of a sound judge assistant system will help the court deepen the reform.The judge assistant system should be based on China’s basic national conditions,fully investigate the practice of local court development,and combine the development experience of different district courts to establish a scientific and feasible judge assistant system.In this paper,the development process of China’s judge assistant system is the main line,and the practice of the development of judge assistants in China is explored.Through the investigation of the operation of the judge assistant system in the Anglo-American legal system and the civil law system,the author finds the useful experience of the development of the assistant system of extraterritorial judges,and the feasibility of the practice of foreign models in China,and summarizes the analysis of the assistant system of extraterritorial judges in China.Learn from the meaning.Through the implementation background of China’s judge assistant system and the development process of nearly 20 years,some problems in practice are found,including the defects of legislation,selection mechanism,configuration mode,and assessment guarantee mechanism.These problems hinder the progress and development of the assistant system of judges.At the end of the paper,the author made corresponding suggestions on the problems in the practice of the assistant system of judges in China,and explored the path of the development of the assistant system of judges in China.Through the legislation of the assistant system of judges,strict selection mechanism,scientific allocation ratio,and perfect assessment mechanism,the basics were made.The proposal is elaborated with a view to promoting the development of the judge assistant system,promoting the personnel reform of the court,and accelerating the judicial system to deepen the pace of reform.
