| The system of teaching and researching is an important part of the conditional non-prosecution system.How to implement the inspection and study of the minors who violate the law and helping the minors effectively return to the society in a non-penalized environment is the the key to proper implementation.However,due to the short implementation time of the Chinese education and inspection system and the lack of relevant legislation,it is still in the initial exploration stage.Judging from the practice exploration of procuratorial organs across the country,there are still many problems in the system of teaching and learning in China,such as the unclear nature of the teaching and learning,the inconsistency of inspection norms,the imperfect supervision measures,etc.These defects and deficiencies need to pass legislation and judicial.In order to further modify and improve the system of teaching and research with conditional non-prosecution,and promote the development of theoretical research and practical work of the system,this paper discusses the system from the following four parts.The first part is mainly the basic content of the conditional non-prosecution and teaching inspection system,including the basic concept,main features and connotation value of the teaching and learning system.By introducing the provisions of our country’s law on the system of teaching and learning,and combining the practice of the domestic and foreign teaching and learning system,the concept and characteristics of the system of teaching and learning are clarified.At the same time,the system of teaching and researching is compared with community corrections,and the particularity of the system of teaching and learning is analyzed.On this basis,the paper further analyzes the connotation value of the system of teaching and learning.As a special system for the protection of minors,the value is to give minors who have a slight crime situation a chance to rehabilitate and protect them through non-penalization to help them return to society.The second part mainly compares the inspection and study system of major countries outside the region.This section introduces the relevant systems of Japan,Germany,the United Kingdom and other countries.Through the comparative analysis of the objects,subjects and contents of their teaching and learning system,the characteristics and advantages of the relevant systems of each country are obtained,and the system for improving the education and teaching in China is provided.Refer to the realistic standards and draw on advanced experience.The third part mainly introduces the current situation and existing problems of China’s conditional non-prosecution and teaching inspection system.By expounding the practical exploration of the Beijing Haidian District People’s Procuratorate,the Shanghai Pudong New Area People’s Procuratorate and the Guangzhou Nansha District People’s Procuratorate,the current situation and existing problems of the Chinese education system are described.At present,China’s procuratorial organs have actively explored the work of helping and teaching,and have achieved certain results,which is worthy of recognition.At the same time,there are still certain problems in the inspection and study work of our country.For example,the main body of the education is not clear,the inspection norms are not uniform,and the supervision measures are imperfect.We still need to further modify and improve.The fourth part is based on the purpose of the in-depth study of this paper,and puts forward the basic ideas for perfecting the system of teaching and learning in China.In view of the problems existing in China’s help and education system,and drawing on the advanced experience of relevant systems in extraterritorial countries,we can improve from three aspects: First,government departments should set up special education institutions to help and teach,and actively guide the public to participate.Help the teaching work.Secondly,it is necessary to formulate a unified norm for the study of teaching and learning,and establish the general principles of the practice of teaching and learning and the special handling principles.Finally,we should improve the supervision system of the teaching and learning system,and formulate scientific evaluation standards and perfect supervision measures and methods. |
