An Analysis On The Protection Of Publishers' Editing Rights In The New Media Era

The publication of a work requires not only the hard work of the author,but also the modification and improvement of the publisher.In the process of publishing,the publisher has injected countless painstaking efforts,provided intelligence and mental labor,and consumed a lot of manpower and material resources.However,in the current copyright protection system,the protection of publishers' editing rights is far from enough,and is restricted by the author's editing rights,the protection of the integrity of works and other aspects.With the development of new media era and the rapid development of electronic publishing industry,the existing copyright publisher protection system has been stagnant,which has gradually affected the development of publishing industry.Therefore,how to explore a reasonable effective publisher editing rights protection system,in the author's rights and find a balance between the rights of publishers,in protecting the right of publisher editing at the same time,can protect the authors modify the free again,become a new subject test of intellectual property law,build a publisher editing rights protection system is imminent.The research object of this paper is the protection system of publishers' editing rights in the new media era.First of all,this paper makes an in-depth comparative study on the definition of publishers' editing and modifying right,the way to obtain it,and the difference between publishers' editing and modifying right and authors' modifying right,editing right,compilation right and protecting the integrity of works.Secondly,it summarizes the current situation of the protection of publishers' editing and modifying rights in China,and putsforward the changes of the publishing industry in the new media era,leading to the limitations of publishers' editing and modifying rights in China in the new media era.At the present stage,there are some deficiencies in the protection system of publishers' editing rights in China,such as inaccurate identification of publishing editors,unclear attribution of revised works,and lack of publishers' protection awareness.Again,according to the jurisprudence of power and responsibility unifying principle,the principle of equal rights,freedom,and the concept such as rules and intellectual property rights of intellectual labor,publishing editors mental rights and economic rights enjoyed by the publisher researches in editing rights,and put forward under the new media age the necessity of strengthening publisher editing rights protection.If the law neglects the protection of the right of revision,it will violate the balance of legislation,affect the actual process of editing work,strike the enthusiasm of the publishing industry,and finally affect the construction of socialist spiritual civilization.Then,by using the method of comparative study,the author compares the copyright protection system of the editor's right and author's rights in China with that in foreign countries,and the author's right of reprint and recovery of works in foreign countries can provide valuable reference for improving the protection system of the editor's right in China.Finally,the author analyzes how to improve the protection system of publishers' editing right from two aspects of publishers and legislation.On the one hand,the editor should respect the author,within the scope of their responsibilities in accordance with the principles of careful revision of the author's manuscript.On the other hand,the law should achieve the unity of rights and obligations,comprehensive consideration of all aspects of the overall situation,to achieve impartiality.Combined with the above research conclusion,this paper proposes should correctly understand the era of new media publishing and editing work,treatment of all kinds of publishers fair,clear the ownership of the modified works,under the new media era established publishers necessary right to edit and improve suggestion,constantly build and perfect the publisher editing rights protection system of our country.
