Investigation And Analysis Of Confession Obstacle Of Criminal Suspect

When the criminal suspect is being interrogated,due to the fact that the suspect is fall under the close custody,and faced with the realistic risks of being investigated for criminal responsibility,they might have deterrent psychology to prevent the occurrence of those risks.In the process of being interrogated,this kind of psychological activity is formed of criminal suspects’ confession obstacles.Based on the reason that caused those obstacles,it can be divided into five categories which are the sinner psychology,fluky psychology,resistant psychology,pessimistic psychology,and the psychology of the wariness.Those five types of obstacles do not exist in isolation,they are an inter-related and inter-influenced as a whole.In the whole,some of the obstacles are the derivatives of others,for example,sinner psychology is the most basic one,others can be seen as generated by it,fluky and resistant can also cause wariness psychology etc.in addition,there would always be a leading one in these five types of obstacles.Following with the continuous development of interrogation situation,the way that to against interrogation may also changing,therefore,the analysis of each criminal suspect’s confession obstacle,performances,the leading one,and the targeted way to eliminate those obstacles would have significant meanings to ensure the accomplishment of the interrogation.In this thesis,author analyzed the confession obstacles by combining theoretical analysis with empirical research and then offered some countermeasures.The thesis is divided into three chapters.The first chapter is the overview of the confession obstacles,expounding the brought up of the issue,significance of studying,domestic and overseas researches,methodology of this study.The second chapter is the empirical research of those obstacles through the way of questionnaire and interview,analyzed the detail of those leading reasons,manifestations and so on.Then drawing the conclusions,which are,the sinner psychology is ubiquitious,lack of evidence in the case is easy to cause the suspect to have fluke psychology,and so on.Combining with the results from the second chapter,the third chapter then put forward targeted and applied interrogation countermeasures according to the different confessional obstacles,so as to bring the reference and the use for reference to the practice of investigative interrogation.
