Practical Problems And Countermeasures Of Community Correction

With the gradual development and maturity of the idea of "socialization of execution",some scholars further put forward the theory of "human rights of criminals" and "the principle of modest punishment",which enriched the theoretical basis of community correction system.The development of community correction system in China started relatively late,but it has also made some achievements in the accumulation of experience and theoretical development.Through the combination of theoretical analysis and practical investigation,this paper discusses the current mainstream community correction theories,such as socialization of execution,humanitarianism of penalty,modesty of penalty and so on.At the same time,through interviews with grass-roots judicial staff to understand the actual situation of the community correction work system,find out the shortcomings in practice and put forward solutions to the shortcomings.At the same time,this paper analyses the community correction system in the United States,Japan,Taiwan and other countries and regions,and summarizes the experience of full-time correction officials,strengthening the role of civil forces in community correction,and incorporating community correction into the prison system for management,which can be used for reference by our country.Through on-the-spot investigation,data analysis and case collection,it is concluded that there are some problems in Huizhou community correction system,such as low management level of staff in grass-roots judicial institutes,formality of the "two-eight-hour" system and insufficient funds for community correction.In view of the above problems,the author believes that the following measures should be taken to strengthen the construction of community correction system: fully relying on the geographical advantages of local prisons to improve the management level of community correction work and build an educational warning base;giving full play to the advantages of lawyers’ extensive participation in the "Vice-Director of Village(Residence)Legal System",and introducing the Vice-Director of Legal System into the community.District correction management system,strengthen the rule of law education for community correction personnel to solve the problem of learning difficulties of community correction personnel;give full play to the advantages of volunteer organizations to guide correction personnel to participate in social volunteer services,to solve the problem of community service difficulties of community correction personnel;strengthen the systematic construction of community sanctions measures to highlight community correction The punitive function of correction and the introduction of commercial insurance to solve the personal security problems of social correctors during the correction...
