Exams have a long history and cheating in exams has a long history.On July6,2015,seven of them were taken as candidates for cheating on the test of the college entrance examination in Jiangxi province.They failed to make achievements and suspended their participation in various countries’ education exams for 3 years.For seven candidates,they were suspended for three years in various countries.The agent who cheated on the organization examination was charged with the crime of ‘forging resident identity card’.Administrative penalties can only be imposed on those who take the test and those who are substituted.In 2015,Jiangxi tourist trade vocational college teachers and social intermediary personnel,complicity in Nanchang city east lake area,Qingyun spectrum area administrative and hospital staff,to register for examinations in Jiangxi examinee irregularities,physical examination,and then implement their stead.Nanchang Donghu district procuratorate has taught in accordance with the law of the original Donghu district bureau of staff,suspected of dereliction of duty,taking bribes,to the east lake city district court to Sue.For a long time,the crackdown on cheating in exams has been solved by administrative means or by relatively weak criminal means,which can’t touch the people who cheat in exams.On November 1,here is a new crime which is focusing on cheating in the exam.From the provisions of the criminal law amendment(9),not any violation of discipline in any examination constitutes a crime.Its scope of application has certainlimitations,for cheating in the exam organization blow is uncertain,this paper is focused on analysis and discussion on several problems in organizational cheating crime,but this point of view,to cheat in the exam organization crime present situation analysis,objective elements,with one standard,the behavior of the ‘organization’ and‘introduction’ to distinguish the boundaries,into the punishment scope of national examination to understand,organize series of cheating in the exam implicated relation between crime,units for cheating in the exam the organization crime the main body of the convicted several difficulties,such as problems were discussed and studied.I wish I can get as much as possible to improve and enrich this crime,it can purify the exam in a larger scope environment,strengthening the examination fairness,manifests the integrity test,strengthening the socialist core values and significance of the socialist rule of law,make examination play its proper justice fair property for the socialist construction of talent cultivation and talent reserves play a proper role and contribution.
