Organize Research On The Crime Of Cheating In Exams

The examination is the most fair and objective system for selecting and examining the level of talents in China.However,this system has always been interfered with the cheating behavior of the examination,which has a great negative impact on China’s examination system,national talent strategy,candidates’ interests,and social atmosphere.The Criminal Law Amendment(IX)will fill the gap in this field in legislation after it has incorporated the cheating crimes of examinations and the cheating of relevant examinations into the criminal law system.Therefore,this paper will analyze and study the issues related to the organization of cheating on exams,and explain their own views.Firstly,through the research background,this paper analyzes the characteristics,frequent causes and harms of cheating behaviors in China,and combines the research status at home and abroad to expound the necessity of this paper.Secondly,through the analysis of the legislative background,legislative process and related concepts of organizing cheating crimes,the basic concept of this crime is grasped in detail.Thirdly,this paper will analyze the criminal constituent elements of this crime in detail from four aspects: the object,the objective aspect,the subject,and the subjective aspect of the crime of cheating in exams.Focus on grasping the connotation and extension of the "legal regulations","national examinations","examination cheating behaviors","organizational behaviors",and "helping behaviors" in the objective aspects of this crime.Finally,through a detailed analysis of the judicial determination of this crime.Through the sin and non-crime of this crime,the relationship between this crime and similar crimes,joint crimes,criminal forms,etc.,establish the standards in the judicial practice of this crime.
