Empirical Study On Emergency Law Enforcement

In 2014,the private lending crisis broke out in W county,and the W county government responded quickly to deal with the crisis.By personally participating in the whole disposal process,the author finds that the W County government's disposal mode of the crisis presents the characteristics of "weak supervision and strong disposal".The crisis disposal mode of this characteristic can not be explained by any existing administrative law enforcement mode.What should be the explanation of this disposal mode? No one in academia has made a summary or study.Through in-depth analysis and comparison of relevant theories on private lending crisis of enterprises in W county,the author finds that the most prominent feature of this law enforcement mode is "first aid",so the law enforcement mode is summarized as "first aid law enforcement" mode.What are the similarities and differences between emergency law enforcement mode and other types of law enforcement mode? How to change the first aid law enforcement mode? These are the questions that this article will answer.The study of emergency law enforcement mode not only helps to improve the theory of administrative law enforcement,but also reveals the problems that W county government shows in dealing with the private lending crisis of enterprises.The main problems include: inadequate prevention in advance,emergency treatment in the event,and no summary review afterwards.According to the problems presented by W County government,the author puts forward some suggestions for the reform of first aid law enforcement mode: improving administrative legislation,building a preventive mechanism in advance,building a cooperative and accountability mechanism,improving law enforcement supervision mechanism,and introducing performance management system.The structure of this paper is divided into five parts.The first part is the introduction.Firstly,the question of this paper is put forward.What kind of administrative law enforcement mode should be used to explain the treatment of private lending in W county? What are the differences between emergency law enforcement mode and other types of administrative law enforcement mode? Then it explains the background and value of the research,summarizes the existing law enforcement model and the research of folk financial supervision in academic circles;then,it is the research design of this paper,and explains the research object,research ideas and research methods;finally,it points out the innovation and shortcomings of this paper.In the second part,the author points out that first aid law enforcement is a phenomenon that can not be explained by current theories.This part is divided into four sections: the first section is the performance of emergency law enforcement;the second section is the meaning of emergency law enforcement;the third section is the characteristics of emergency law enforcement;the fourth section points out why the existing theory can not explain emergency law enforcement.The third part is to show the supervision of W county government on private lending of W County enterprises.This department is divided into three sections: the first section combs the national legislation of private enterprise lending;the second section elaborates the supervision mode of private enterprise lending;the third section elaborates the characteristics of private enterprise lending supervision,mainly in two aspects: multi-management and inadequate prevention in advance.The fourth part is the case of private lending crisis of enterprises,mainly combing the whole process of private lending of J company.First,the access to private lending,then the operation of private lending and the emergence of the lending crisis,and finally the government's supervision of private lending.In the fifth part,the author puts forward some suggestions on the reform of emergency law enforcement.There are five main aspects: the first is to improve administrative legislation;the second is to build a preventive mechanism in advance;the third is to build a collaborative and accountable mechanism;the fourth is to improve the law enforcement supervision mechanism;and the fifth is to introduce performance management mechanism.
