As laws and regulations determining the economy nationality of goods,rules of origin are important parts of free trade agreements.China,Japan and Korea are all major economies in the Asia-Pacific region.However,the free trade agreement has not yet been reached among them.The Spaghetti bowl phenomenon is one of reasons negatively affect the expected progress of CJKFTA negotiations.Since CJKFTA negotiations started in 2012,researches on CJKFTA have sprung up one after another.However,most of them focus on in the field of economics and politics.Only very few are from the perspective of international law,let alone comparative study on preferential rules of origin among China,Japan and Korea.To seize the initiative for arrangement of rules of origin in CJKFTA,comparative study has been carried on for preferential rules of origin in eighteen representative FTA agreements.As result shows,China has four disadvantages compared with Japan and Korea on preferential rules of origin.First,fisheries are lack of effective protection under recognition criteria of wholly obtained or produced goods.Second,application of recognition criteria of non-wholly obtained or produced goods is inelastic.Third,attached rules have not received enough attention.Fourth,low level of transparency and convenience block the implementation of procedural rules.To establish core provisions of rules of origin on the ground of China,this thesis put forward six legitimate suggestions which balance the interests of three parties.
