In the past 40 years of reform and opening up,China has adhered to the basic state policy of opening up and achieved great success.External exchanges have been expanding and social and economic development has been sustained and steady.China has a large number of employment,business and learning opportunities,as well as a safe and stable living environment.Our country has been gradually transformed from the original illegal immigration export country into the transit and import country of illegal immigration.As more and more on the entry of our country,with "illegal entry","illegally","illegal employment"(hereinafter referred to as the "three")as the main form of foreigners violates the laws and regulations of exit and entry management phenomenon is spreading to expand,to our country's national security,social stability,employment environment caused serious damage.For a long time,because the concept of law enforcement,law enforcement system in our country and defects of the entry and exit management legislation,ACTS violating the administration of entry and exit of foreigners and relies mainly on the means of administrative management and administrative punishment,criminal punishment means is insufficient,penalties,result in violation of the exit and entry to foreigners illegal treatment the effect not beautiful,and also continue to worsen trend.From the perspective of criminal crackdown,the author studies the punishment of foreigners' violation of exit and entry administration.The first part of this article is an overview of the immigration violations by foreigners.This paper mainly introduces the concepts related to the entry and exit management,the definition,characteristics,manifestation of the violation of the entry and exit management by foreigners,as well as the relations and differences with illegal immigrants.The second part introduces the current exit-entry management system for foreigners in China.This paper mainly introduces the relevant information of the entry and exit management system of China and the entry and exit management system related to foreigners.The third part is to introduce the external development of foreign countries in response to the violation of exit and entry management,mainly including the international legal system,international cooperation mechanism and the practical experience of developed countries.The fourth part is the deficiency and risk of China's foreign-related entry-exit management system,including the status quo of aliens' violations of entry-exit management,relevant legal defects and hazards,and clarifies the necessity of strengthening the criminal punishment for foreigners.The fifth part is the reflections on penalties for foreigners violating the entry and exit administration,mainly including exploring new ideas,applying scientific and technological means,strengthening team building,strengthening international cooperation and criminal legislation.
