In China,the auxiliary police system is a social governance tool with a certain history.The involvement of private subjects in social governance is bound to be accompanied by great controversy.The focus of academic disputes is on the main position,rights attributes,scope of duties,hiring methods and management mechanisms of the Auxiliary Police.In 2012,series of local government regulations on the management of auxiliary police were issued,and the theoretical disputes did not stop because of the different regulations.Regarding the legal orientation of the auxiliary police,the administrative entrustment and the assistance of the two universities have been swaying,and the nature of the power exercised by the auxiliary police has not been clear enough.The regulations on the scope of the auxiliary police are not uniform.In the absence of the upper-level law,the direction of the development of the auxiliary police system in each city is not consistent.With the promulgation of the local regulations of the Shenzhen Special Economic Zone Police Auxiliary Personnel Regulations(hereinafter referred to as the “Regulations”),it indicates that the legalization of the construction of the Shenzhen Auxiliary Police System has reached a new level at the theoretical level.Although the "Regulations" evaded the debate about whether the auxiliary police are administrative entrustment or assisting the administration,the established auxiliary police support principle basically establishes the responsibilities of the auxiliary police in carrying out their duties;Removed the label of the "temporary workers" and "informal forces" of the auxiliary police for a long time;At the same time,the combination of foreign mature systems and local realities has established a full-time and part-time employment method.Drawing on China's police supervision system,the establishment of the auxiliary supervision system is an important supervision mechanism;it affirms the regional financial support under the Auxiliary Police quota system,and basically solves the worries of the auxiliary police practice.From the perspective of basic theory and legal connection,there is still room for revision in the Regulations.Based on the reclassification of police tasks from the perspective of police power,the scope of duties of the auxiliary police can be further clarified;As far as the auxiliary police access is concerned,it is necessary to refine the procedural access mechanism and modify the substantive requirements of the auxiliary police to achieve the purpose of coordination with the superior law;At present,the "Regulations" lacks the promotion mechanism of the auxiliary police,and the establishment of internal upward channels is of great significance in improving the team's ability to perform tasks and improve management efficiency;Finally,the legal responsibility that the Auxiliary Police may undertake in the performance of the duties needs to clarify its nature and construct a corresponding accountability mechanism.The "Regulations" is a good starting point for studying the legalization of the construction of the auxiliary police system.The experience of legalization of the construction of the auxiliary police system in Shenzhen can also be promoted and borrowed in the future,and promote the national auxiliary police system through the "point-to-face" approach.
