| Employment is related to national stability and is an important part of a country’s social security system.The employment of the disabled is not only the basic measure of helping the disabled to self-respect and self-improvement,but also an important manifestation of the national human care and social development progress.Under the background of economic globalization,solving the employment of disabled persons is becoming a new important direction in the economic and social construction of all countries.By establishing a perfect legal system to guarantee the employment of the disabled,to avoid the employment rights of the disabled,to enable the disabled to find their own ability and to create their own values,which is the key aspect of the state’s protection of the human rights of the disabled and the strengthening of the social quality of the society.Jiangsu province belongs to economically developed provinces in our country,the province one of the leading enterprises in the national social security work,the disabled employment compared with the national has certain representativeness,at the same time it still has the common in other provinces.At present,the number of disabled people in jiangsu province is 4.793 million,accounting for 6.4% of the total population of the province and involving more than 14 million families.Therefore,the research on it can not only summarize and popularize the experience it has gained,but also find out targeted and nationwide experience and practices through the analysis of problems.This paper takes Jiangsu Province as an example to analyze the legal protection of the employment of disabled persons in China.Disability is the negative influence of the interaction between individual and personal factors and environmental factors in certain health conditions;therefore,the right to employment of disabled persons means that disabled persons and other social groups can carry out normal labor activities and obtain corresponding rewards.s right.At the same time,based on the demonstration needs,the basic human rights,humanitarian and functional deficiencies were analyzed,and these papers were used as the basis for the analysis of this article and the proposed countermeasures.At present,the employment patterns of disabled persons adopted by Jiangsu Province include four modes of centralized employment,proportional employment,individual employment and auxiliary employment.The relevant laws and regulations in Jiangsu guaranteeing the equal employment rights of persons with disabilities mainly include the “constitution” and “employment” at the national level.Promotion Policy,Protection of Disabled Persons,Employment of Persons with Disabilities,and Opinions on Promoting Proportionate Employment of Persons with Disabilities,etc.,Provincial Level Protection Regulations for the Protection of Persons with Disabilities in Jiangsu,and Jiangsu Province Proportional Arrangements for the Employment of Persons with Disabilities,Regulations for the Administration of the Acquisition and Use of Disabled Persons in Jiangsu Province,and Regulations and Regulations of Jiangsu Province on Legal Aid.Through the analysis of the current situation of the protection of persons with disabilities in Jiangsu Province,we have sorted out three problems in the protection of equal rights for employment of persons with disabilities in Jiangsu Province: imperfect laws and regulations,imperfect organization systems,and difficult access to judicial relief.The measures for collective measures: First,strengthen the legal system for the protection of disabled persons with equal employment rights,including the formulation of the "Jiangsu Province Anti-Disabled Persons Employment Discrimination Measures" and "Jiangsu Province Regulations on the Implementation of the Employment of Persons with Disabilities" in detail.The second is the strengthening of the organizational system for the protection of the equal employment rights of persons with disabilities,including clarifying the responsibilities of local governments and departments at all levels,setting up a special employment protection agency for disabled persons,and establishing and improving the employment assistance system for disabled persons.The third is to strengthen the institutional system for ensuring the equal employment rights of persons with disabilities,including the construction of a system of inversion of the burden of proof,the establishment of a sign language trial and translation system,the establishment of a legal aid system for the protection of the employment rights of persons with disabilities,and the improvement of a social security system for disabled persons. |
