Study On The Evaluation Mechanism For The Local Rule Of Law

To assess the status of local rule of law is a new phenomenon in theprocess of promoting the rule of law at present in China.It is necessary to conduct a thorough study on the operation mechanism of the local rule of law.The paper is mainly studying the cause-and-effect,the main contents and the acceptance mechanism of the evaluation results by taking the rule of law in M District of the S city as the research object.The transformation and upgrading of the local economic and social,the involvement of experts and scholars and the promotion of the local Party committees and governments are the structural causes for the rise of the local rule of law.While taking it’s legal or not as a judge standard,the evaluation study on the local rule of law in M District is mainly based on the five dimensions--exercising state power according to law,perform official duties lawfully,ensuring an impartial judicature,advocating socialist legal system and developing grass-root democracy.The third party is the main body of the rule of law in the M district to achieve the evaluation,while the evaluation of the units,the NPC,the CPPCC members and the public is the appraise subjective.The Objective index method,questionnaire,symposium,interview and collection of information on line are the main sources of the information of the rule of law.Meanwhile,M district also clearly provides the use of evaluating results of the rule of law,which is closely connected the performance appraisal of the units to the civilized competitions and the concise and promotion of the experience.However,there are still a lot of problems in the local rule of law which is represented by M district.The promotion of the rule of law is mainly relying on the leaders of the local Party Committees and government.It also quite closed during the process of the assessment and the use of the results,and the formal evaluation method easily leads to formal results.As a result,it is necessary to transfer the local legal evaluation model from the type of charisma,closure and formalization to the type of the legal theory,openness and substantive.It is obviously that the problem-oriented assessment of the rule of law is helpful to the construction of China’s rule of law,while reversed function of assessment of the rule of law is also take the specific condition as a prerequisite.In the foreseeable future,the local rule of law assessment model may not have a fundamental change,but it can optimize the local rule of law assessment from the angle of protecting the third party more objective and neutral,making the community and people involved in the assessment and furthering the transparency and institutionalization of the assessment results and its application.
