Research On The Establishment And Restriction Mechanism Of State Supervision Power

Supervision has great significance in the historical development of our country.Since the establishment of the state,supervision has been accompanied.In ancient times,supervision mainly focused on checking and balancing power within the ruling class,which more reflects the distrust of 100 officials.Since contemporary times,our country has also made many explorations on how to exercise the power of supervision.Its core is more reflected in the effective restriction of public power in order to achieve higher efficiency and fairness.Recently,through the amendment of the Constitution,the nature of the institutional rights of the supervisory power has been effectively positioned,making it a genuine constitutional institution;through the enactment of the Supervision Law,the supervisory committee has been formally defined as the attribute of the state organ,enabling it to have the ability to integrate the resources of all current anti-corruption countries,and at the same time gaining independent supervision without interference.Power and the extension of supervision to all public officials exercising public power.The establishment and perfection of laws and the strong establishment of institutions can make better use of supervisory power and make better contributions to the clarity of social ecology and the limitation of public power.However,although the centralization of power is a good thing and can concentrate on major affairs,the power itself has the characteristics of corruption,and trust can not replace effective institutional supervision.Therefore,in the process of founding a strong supervisory organ,we should also design the restriction system rigorously.I think we should regulate the production,supervisory duties and powers of the supervisory organ by organizational law,avoid the formation of supervisory organizations which are not controlled because of their huge power,standardize the activities of the exercise of supervisory power by procedural law,and prevent the supervisory organ from abusing supervisory power or even exceeding supervisory power.The occurrence of violations of human rights aims at the real realization of anti-corruption,with the effective protection of human rights as the ultimate goal of supervision.Power is like a tiger,which can deter or hurt people.Only the chain can move forward and backward with evidence.It can catch the horse of the pest and return to the cage.
