On China’s Limited Recognition Of Dual Nationality Under The Background Of "One Belt And One Road"

In the autumn of 2013,general secretary Xi Jinping proposed to build a "one belt and one road" initiative.After 5 years of ramming bases and columns,building a "one belt and one road" is becoming China’s plan to participate in global open cooperation,improve the global economic governance system,promote global common development and prosperity,and promote the building of a community of human destiny.In this context,China’s level of opening up will be further expanded,private exchanges will be more frequent,and the exchanges between citizens of all countries along the line will continue to increase.With the diversification of the nationality background of the current population,China will face the new trend of dual nationality system under the background of "one belt and one road".The voice of overseas Chinese’s ownership,the need for policy follow-up on the introduction of talents and funds,the need to expand the jurisdiction of foreign jurisdiction,and the resistance to entry and exit of some persons who actually hold dual nationalities encountered in the work of the author urgently require the reform of the current single nationality system in China.In dealing with the problem of dual nationality,China has had practical experience in solving the problem of dual nationality with Indonesia,Hong Kong and Macao Special Administrative Regions.The practice of dual nationality legislation in some foreign countries has also provided a useful reference for China to revise its nationality system.China should be cautious about the change of nationality system and seek a pluralistic dual nationality solution.On the one hand,the recognition of dual nationality is in line with the social reality of the current dramatic increase in the number of dual nationality population,and is conducive to the introduction of technology and other resources,the expansion of foreign jurisdiction,etc.On the other hand,due to the imperfection of the supporting system related to the recognition of dual nationality and the lack of social risk regulation mechanism under dual nationality,China can only recognize dual nationality to a limited extent.Under the background of "one belt and one road",China should adhere to the basic principle of "one person,one nationality" and a single nationality system.It has a limited recognition of dual nationality and its civil rights in some areas and populations.In legislation,we should delete the existing provisions of denying dual nationality,amend the "automatic loss" clause,and sign bilateral naturalization agreements,rationally restrict the citizenship of dual nationality citizens,and gradually form a nationality system that accords with Chinese characteristics and promotes the development of the country,with a view to continuously promoting the "one belt and one way" process.
