Nationality Conflicts And The Recognition Of Dual Nationality

The rapid development of globalization makes the countries in the word communicate more frequently, and some global phenomena such as marriages, studying abroad, visiting friends and relatives,adoptions and transnational migration are also increasingly appearing. All of these phenomena all touch on the issue of nationality of natural persons. At this stage, the national legislation about natural person's nationality are almost based on their traditional practices, political and economic conditions with the purpose of safeguarding their national interests maximumly, the uniform standard about natural person's nationality has not taken shape, which in turn will inevitably lead to the appearance of conflicts of nationality, in which the phenomenon of dual nationality is a major problem plaguing most countries.In the past long time, most countries of the word did not recognize people's dual nationality, but with the development of the new international situation, the countries denying dual nationality began to adopt a tolerant attitude on the dual nationality in order to favor its own interests, including explicit recognization, implied acceptance or conditional acceptance. As the biggest developing country in the world with the fastest speed of economy develoment and a big population, thanks to the further deepening of reform and opening up, China is faceing more and more conflicts of nationalty in the process of bringing in talented persons.The nationality law promulgated in 1980 has always insisted on the principle of single nationality, which unable to do as much as it would like to in solving conflicts of nationality in the new situation. In order to protect national interests and security, Chinese government adopted the single nationality policy which does not allow overseas Chinese's have dual nationality. Such policy had a positive effect at that time, but with the raising of China's international status in the word, overseas Chinese's living environment has not been so bad, they mostly have a strong economic strength instead. These overseas Chinese are all have the desire to invest motherland and contribute share for motherland's reunification and development, for which they are eager to regain Chinese nationality. Facing with these new circumstances, in order to realize China's peaceful rise in the word, China should have a more long-term perspective and the breadth of mind of making all rivers run into sea to accept dual nationality of citizens in a way of taking a limited recognition of the principle, only we do this,can we meet the needs of gaining Chinese nationality of overseas Chinese way to meet some special groups pressing for dual nationality call; only we do this,can we create a favorable international environment and bring in more talented persons in the word for the rapid development of China's economy.This paper systematically discusses the basic theories of nationality firstly, based on which the thesis primary studys conflicts of nationality, dual nationality and the practice activities in dealing with conflicts of nationality in the following chapters.The goal I do these work is to provide my suggestions and methods in solving conflicts of nationality.
