Research On The Difficulties In Civil Enforcement Under The Background Of “Internet +”

The difficulty of civil execution is one of the "three difficulties" of judicial practice in China.Solving the difficulty of civil execution is the common aspiration of people from all walks of life.The development of Internet technology has made it easier to achieve the goal of solving difficulties.The introduction of Internet technology into civil execution has brought about new changes in civil execution work,making it easier to find people and find property,and the efficiency of property disposal has also been greatly improved,and at the same time promote the construction of social credit system.However,there are still many problems in using Internet technology to solve the implementation difficulties.The legal basis for standardizing civil execution is not sufficient,the application of Internet technology in solving civil execution difficulties,and the problems in the application of Internet technology to solve civil execution difficulties.Neglect the protection of the rights of the parties.Therefore,when using the Internet to solve civil enforcement difficulties,we should improve the legal norms,broaden the application breadth of the Internet,and strengthen the application depth while also paying attention to the protection of the rights of the parties.The main content of this thesis has four parts.The first part is an overview of civil enforcement difficulties.It mainly defines the concept of civil execution difficulties,expounds the performance of civil execution difficulties,and analyzes the causes of civil execution difficulties.The second part is the current situation of the court using Internet technology to solve civil enforcement difficulties.The main focus is on the practice of some excellent courts using the Internet to solve civil enforcement difficulties,and analyzes and summarizes the current court’s use of the Internet to solve the difficulties of civil execution.The third part is the problem that the court still uses Internet technology to solve the civil execution difficulties.The lack of sufficient legal basis for the use of the Internet to solve difficulties in implementation,the lack of breadth and depth of Internet applications,and the lack of protection of the rights of the parties have hindered the use of the Internet by our courts to resolve the difficulties of civil execution.The fourth part is the proposal to further use the Internet to solve civil enforcement difficulties.Through the third part,we analyze the problems still existing in the use of the Internet to solve the civil execution difficulties,propose suggestions for solving these problems,and further advance the process of cracking the difficult work.
