On the one hand,e-commerce based on network information technology has become an important model for the development of China’s market economy.On the other hand,e-commerce companies that have emerged along with the rapid development of China’s economy have successively appeared in a series of socially influential events such as Ali Jingdong’s second election and “micro-envelope killing Taobao”.Whether this series of events caused by e-commerce companies constitutes abuse of market dominance is not accurately determined.Firstly,the behavior of e-commerce companies to abuse market dominance is not only highly concealed,but also has certain legitimacy.Secondly,the economies of scale,network effects and bilateral market effects of e-commerce companies have caused traditional methods to fail to identify abuse of market dominance.So the end result is that these incidents have occurred and caused bad effects,but they cannot be punished as they should.The first part of the thesis expounds the concept of e-commerce enterprise,introduces the characteristics of e-commerce enterprise and the particularity of e-commerce enterprise’s abuse of market dominance,analyzes the reasons for e-commerce enterprises to abuse market dominance,and describes the standardization of e-commerce companies to abuse the market.The necessity of dominance;the second part of the thesis first introduces the types of abuse of market dominance by electronic enterprises,and then analyzes the definition of e-commerce-related markets and the dilemma of abuse of market dominance,and analyzes and determines that e-commerce companies abuse market dominance.The difficulty of status and the status quo of the legal regulation of the abuse of market dominance in China’s e-commerce enterprises;the third part mainly introduces the relevant theoretical and legal provisions on the issues related to the abuse of market dominance of e-commerce enterprises in the United States and the European Union,and analyzes the relevant China’s e-commerce companies have a relevant experience in abating the legal regulation of market dominance.Finally,this paper puts forward some suggestions for the development of China’s e-commerce enterprises and the existing problems. |
