Private car sharing,also known as carpooling and hitchhiking,is a shared travel mode in which the travel information is released in advance by the carpool service provider,and people with the same travel route choose to take the driver's car and share the travel cost of the carpool part or help each other free of charge.The paid car sharing is characterized by affordability,non-profit,mutual assistance,convenience,and tool qualification.The network company which provides ride-sharing information also plays an important role in the relationship in the mobile Internet environment.The paid car sharing belongs to a nameless contract free of charge.Drivers have the obligation to carry and drive safely according to the contract,and passengers have the obligation to pay for the ride in accordance with the contract and assist in safe driving.According to the different claim rights,different imputation principles are applied to the tort damage in the car sharing:the principle of no-fault liability based on the car sharing contract and the principle of fault liability based on the tort liability.In terms of insurance,it is necessary to set up insurance coverage specifically for the car sharing in order to reduce disputes over insurance claims.The network company has the dual identity of broker and manager,and should assume the dual obligations and responsibilities of broker and manager.In case of infringement damage,there may be a coincidence of two kinds of liability on the network company.
