At present,many manufacturers in many countries around the world have developed intelligent automobile and conducted a lot of practical tests on the road.It is expected that quantitative production of intelligent automobile will be achieved and the intelligent automobile will be used in social life in the next two or three years.The marketization of intelligent automobile not only brings corresponding traffic accidents and safety hazards,but also may have a series of legal problems.Therefore,the establishment of a smart car supervision system can not only ensure the healthy and sustainable development of the intelligent automobile’ industries,but also properly solve the legal problems that may arise after the smart car market operation.The paper will be proposed to improve the relevant solutions for the legal supervision of intelligent automobile in China through that will be used comparative analysis,literature analysis and other methods to analyze and summarize the legislation of intelligent automobile in the United States,Britain and Germany on the basis of the analysis of the necessity of smart car supervision,and learn from experience of foreign legislation on intelligent automobile.In addition to the introduction and conclusion,the paper is divided into three parts:The first part analyzes the necessity of smart car supervision.First of all,intelligent automobile are not absolutely safe,and they may infringe on public transportation safety after market operation.Secondly,because intelligent automobile have different intelligence from traditional cars,their network systems will face the risk of being invaded by hackers during operation.Once again,the smart car s will collect,store,and use the users’ personal information during the operation,and the personal information of users is also at risk of being compromised.Finally,the regulatory system of traditional cars cannot be applied to the inspection,licensing and insurance ofintelligent automobile.It is for the above reasons that it is necessary to establish a supervision system for intelligent automobile in advance.The second part explores the supervision systems of foreign intelligent automobile and their enlightenment.It can be seen that the supervision systems of foreign intelligent automobile have the following characteristics through the analysis of relevant legislation on intelligent automobile in the United States,Britain and Germany.Developed a detailed road test system and market access system of the intelligent automobile;pay attention to the regulations on the safety performance and the network security of intelligent automobile;focus on the protection of users’ personal information;expanded the insurance system of traditional cars to adapt to new intelligent automobile.The third part analyzes Chinese smart car supervision system and its improvement.We should build and improve the supervision system of intelligent automobile from the following aspects through refer to the relevant legislative experience of foreign countries on intelligent automobile:first of all,we should improve our road test system of current intelligent automobile and establish corresponding testing,licensing system and market access system.Secondly,the relevant departments should conduct continuous supervision and regular audit of intelligent automobile to ensure the normal operation of the intelligent automobile’ industry market.Finally,it is necessary to establish a corresponding insurance and margin system,a network security system,and a user information security protection system to protect the further development of intelligent automobile.
