Legal Regulations On The Digital Utilization Of Cultural Relics In State-owned Collections

Cultural relics are precious and non-renewable resources,which contain the glorious history of the Chinese nation and the time-honored cultural activities of the Chinese people.The wide application of digital technology provides a solution to the problem of the protection of cultural relics and the realization of preventive protection and maximum utilization of cultural relics.The digital utilization of cultural relics in state-owned collections refers to that the subjects of the utilization of state-owned cultural relics digitize the relevant information of state-owned cultural relics by means of digitization,and on this basis,make secondary use of data information to make digital collection,so as to maximize the cultural value and economic value of cultural relics.Throughout the process of digitization of cultural relic resources in China,legal regulations are still insufficient.Firstly,the existing legal norms lay stress on principles,which directly leads to the imperfection of the legal system for the utilization of digital cultural relics resources.Secondly,the existing legal system for the digitalization of cultural relics lags behind.In reality,the utilization of cultural relics' digitalized resources changes with each passing day.The gap between the two causes that in practice,the rights and obligations of the subjects of cultural relics utilization are unclear and their enthusiasm for utilization is low.Finally,due to the lack of legal accountability mechanism for the utilization of digital cultural relics resources in general and the imperfect administrative law enforcement mechanism of cultural relics in particular,it is difficult to strike forcefully against the infringement of digital cultural relics resources.In order to solve the above problems,it is necessary to regulate and improve the digitization of state-owned cultural relics from the perspectives of perfecting the legal system,strengthening the consciousness of the subject's rights and obligations,and improving the administrative law enforcement mechanism of cultural relics.By summarizing practical experience,policies that can better guide the digital utilization of cultural relic resources in reality can be transformed into laws.In this process,data legislation support can be realized by relying on big data sharing mechanism,and relevant systems can be introduced to realize the connection between theories and specific legal provisions,so as to build a relatively complete digital intellectual property protection system.To improve the law enforcement mechanism of digital cultural relics resources,local governments should strengthen organization and leadership,form a departmental coordination mechanism and strengthen departmental collaboration.The responsibilities of relevant power subjects in the digital utilization of cultural relics resources should be reasonably distributed,and a number of high-quality cultural relics administrative law enforcement teams should be trained.We will further improve the mechanism for quick protection of intellectual property rights,step up management and law enforcement,and crack down on the illegal use of digital cultural relics.We will improve the long-term regulatory mechanism for administrative law enforcement.We will strengthen the awareness of law abiding in the protection of cultural relics throughout the society,respect the rights of the public in all aspects of legislation,law enforcement and administration of justice,increase public participation,and create a new pattern for the protection of cultural relics throughout the society.We will form a complete chain of rule of law featuring sound legislation at the upstream,and law enforcement,judicial and law-abiding at the downstream.Finally,the digital utilization of state-owned cultural relics and the linkage of legal regulations will be realized.Through the tool of law to promote the intellectual,professional and scientific development of China's cultural relics.
