Study On The Copyright Protection Of Computer Font Word

In the information age,more attention has been paid to the copyright protection of computer fonts.Computer font word refers to a specific word in the computer font,and the computer font is composed of many computer font words.More countries begin to recognize the originality of computer fonts and protect them.It is also necessary for our country to pay attention to the research and analysis of the originality of computer fonts and clarify the identification standard of the originality of computer fonts as soon as possible.The absence of protection of computer fonts in legislation leads to inconsistent identification of originality standards in several influential cases in judicature,and the ambiguity of originality identification standards increases the difficulty of computer font protection.The original analysis of computer font words should also start from two aspects: independent completion and creativity,which can meet the requirements of independent completion and creativity to a large extent.Moreover,as long as the creativity of computer fonts is appropriate,there is no need to set it higher than the creative requirements of ordinary works.In legislation and judicial practice,the work attribute of computer font is still not clear.With regard to whether it constitutes a deductive work,although in Founder v.P&G,the court did not respond positively to whether the computer font word belongs to the deductive work,the new computer font adapted from the existing computer font can belong to the deductive work.With regard to whether it constitutes a work of art,Founder v.P&G and Hanyi v.Xiaobaxi are similar,but the result is completely opposite.The former denies that the computer font word is a work of art,while the latter supports it.There is no doubt that computer font words have the practical function of conveying emotion and meaning,and shall be excluded from the protection of work of art.With regard to whether it constitutes a work of applied art,when the computer font meets the principle of separation of practicality and artistry and the artistic part meets certain originality requirements,itconforms to the characteristics of the work of applied art.So that the artistic part can obtain the protection of copyright law.From the point of balance of interests and reasonable incentive theory,the copyright protection of computer font words should be reasonably restricted.It is a good way to balance the interests of computer font copyright owners and the public,and should be used in the protection of computer font words.
