Research On The Protection Of The Right Font Font And Word Books

With the development of our national economy, in the judicial practice have emerged some intellectual property dispute case about word stock or the font.Because of our nation has no clear legal norms in this field,the different court made a absolutely different sentence in such cases.Acorrding to the cases in Beijing or Jiangsu province in recent years, the author try to analysis the different courts’attitude and the reson for these sentence,abstracting the feasible way to handle such cases in judicial practice to solving this problem.Finally,refer to other parts of the world for the measures and methods to resolve the problem,put forward the owned proposal for the judicial practice in our nation to deal with this problem.This article is divided into four parts. The first part mainly introduces the view of the legal protection present situation of computer word stock and font. Through analysising typical cases about word stock shows that the intellectual property rights protection situation of word stock and existing problems, and also introduces the experiences of relevant foreign protection. For font protection illustrates the problem of legal protection in our nation at present stage briefly. The second part mainly introduces the related case about font of copyright protection in China, including Peking University Founder V.P&G font infringement, the case of jiangsu xiuying font and the case of Jiangsu Ye Genyou font. This paper concretely introduces the result and reason for these cases.And then explain the attitude of author about above cases.The third part of the article from the determination of the original font copyright illustrates that the original font words shall be protected by law, at the same time, throughing the introduction of other parts of the world for font words of copyright protection, providing experience for our nation of copyright protection to font words in the future. The fourth part of the article mainly introduced how building nexessary rights restritions about creators rights, consumer rights and communicators rights to protecting the font right. So we can balance the interests of society and the individual and balance the interests of the creators, users and communicators.
