Problems And Countermeasures Of Community Correction System In China

Community correction is a new type of penalty execution in relation to imprisonment correction.The criminals who meet the community correction conditions are placed in the community environment,and the deadlines for judgment or ruling are assisted by relevant government agencies,social groups and caring people.Within,make corrective objects correct bad habits and help them return to social punishment execution activities.The community correction system first developed in the West,and its history has been traced back to more than 100 years.However,in 2003,China’s community corrections were implemented in six provinces and cities including Beijing,Tianjin,Shanghai,Jiangsu,Zhejiang and Shandong,and then promoted nationwide.Although the organization and the management system have been established in this process,the community correction work in China started late,and the shortcomings of the “Community Correction Implementation Measures” have different differences in the development of community corrections in China.,formed a different pattern.Due to the lack of macroscopic theoretical guidance,there is a certain degree of blindness in the practice of community correction work in various places,which leads to certain problems in each mode more or less.Therefore,in order to promote the effective implementation of community corrections,we must focus on China’s national conditions,carry out macro design of community correction system,and explore a system of "characteristic" community correction that belongs to China."Economic basis determines the superstructure",so we must systematically explore the basic theories of the community correction system,comprehensively understand the characteristics and values of the community correction system,learn from foreign legislation,and address the lack of uniform legislation in the current practice of community correction in China.The management construction is lagging behind,the community correction implementation measures and the community correction force are generally singularized.The author believes that the community correction legislation process should be accelerated from the legal level,and the subject and object criminal rights should be gradually unified.From the system level,the community correction work mechanism should be improved.Strengthen the professionalization of community correction work teams and establish diversification of community correction implementation MEASURES.
