On The Inheritance Of Virtual Property

With the development of the times and the progress of science and technology,we have entered an Internet era.Network virtual property is produced with the Internet,and its number and type are increasing.The attribution of network virtual property has increasingly become the object of great concern in theoretical circles and judicial practice.As virtual property on the Internet is a new type of property,there is no virtual property in the categories listed in the General Principles of Civil Law and Inheritance Law.Although Article 127 of the General Principles of Civil Law stipulates that "the protection of data and virtual property on the Internet is regulated by law,according to its provisions",it is only a guiding clause,but it only indicates virtual property.The spring of property is coming,and no specific provisions have been made for this clause.This clause alone can not solve the problem of legal vacancy of virtual property inheritance.Whether virtual property can be inherited or not,and the problems that virtual property inheritance will face will become the focus of debate and exploration.Nowadays,people pay more and more attention to the inheritance of their virtual property such as QQ,online stores,game equipment.However,this is doomed to be just the beginning.The inheritance of virtual property will become more and more prominent in our life.Solving the problem of inheritance of virtual property is not only related to our interests,but also a strong social demand.This paper will explore the inheritance of virtual property from four aspects: the overview of virtual property,the feasibility and necessity of virtual property inheritance,the dilemma faced by virtual property inheritance,and the suggestions for the construction of virtual property inheritance system.Mainly put forward the main problems that virtual property inheritance may face,such as the scope of virtual property can be inherited,the value of virtual property and other issues,and boldly put forward some suggestions for the construction of the relevant system.
