Study On The Power List System Of Provincial Government Departments

Since twentieth Century,the expansion of administrative power has become an irresistible trend in the administrative field all over the world.Therefore,the Chinese government focusing on anti-corruption,decentralization,stimulate market vitality and social creativity,has become the top priority of the State Council to promote comprehensive deepening reform and transformation of government functions.Power list system 1s an important system in the process of deepening the reform of our country,but there are still many areas to be improved.This paper is divided into five chapters,the first chapter mainly introduces the power list system researching background and researching significance of the historical evolution of the power list system of our country;the second chapter analyzes the legal basis of administrative law and the value of power list system,give a definition of the power list system from the perspective of jurisprudence;the third chapter discusses respectively from two effects about the judicial practice and legal analysis of the legal nature and legal point,combined with the actual judicial case analysis law status problem of power list system in China,and that China’s power list does not have the legal nature of the conclusion from the legal theory,qualitative norm the file should be the current power list;The fourth chapter takes the implementation status of the Provincial Forestry Department of power list system as an example to analyze the China Power list system.The status of implementation of the focus,summed up the existing power list system of China’s current problems,like program is not strict,insufficient permissions,clear subject power according to the problems in the preparation procedure,and the power classification standards are not unified,the scope and content of incomplete list in content regulation;the fifth chapter establishes two aspects of the list of powers of supervision mechanism.puting forward the specific measures to improve the local government power list system,mainly from the relevant laws and regulations,improve the power list system and supporting the establishment of a list of power system’s responsibility system.
