In recent years,with the booming development of the Internet and the introduction of the Internet +policy,all walks of life have begun to use the Internet information technology to achieve industrial transformation and upgrading.The network reservation for the taxi industry is a typical representative of the travel field.In August 2016,the Interim Measures for the Administration of Network Appointed Taxi Management Services promulgated by the seven ministries and commissions,such as the Ministry of Transport,recognized for the first time the legality of the operation of the network car service.In this context,with the arrival of the economic era in recent years.On the one hand,the development of the network car meets the individualized travel demand of the people and promotes the full use of the idle resources of the society;on the other hand,it also faces difficulties,such as the lack of legal basis,government supervision ideas.Industry autonomy issues,etc.It can be said that how to eff’ectively regulate the network to reserve taxi operating services has become a difficult point in the practice of the rule of law.This paper consists of six chapters.The first chapter is an introduction.The second chapter compares the development process of the network car and the cruise car by comparing the development process of the network car and the relevant provisions of the "Interim Measures",and on the basis of the comparative analysis method,The relevant concepts and scope of the vehicle are defined,and the research object of this paper is clarified.The third chapter discusses the current situation of China’s network reservation taxi regulation and some existing problems from the national and local system level:the legal basis of the administrative license is weak at the legislative level,the local implementation rules are too strict,and the law enforcement supervision level is in the network.The drawbacks of the government-led supervision mode in the regulation process of the car gradually emerged;the autonomous system has an imperfect system of autonomy and lack of relevant autonomous organizations.The fourth chapter compares and summarizes the regulation ideas and methods of the three countries outside the United States,Britain and Singapore on the network car,in order to learn from the practice of China’s network car regulation.The fifth chapter responds to the questions raised in the third chapter.First of all,the legislative proposal proposes to further refine and fill the"Interim Measures" through the central level and positively explain the State Council’s"No.412".On this basis,strengthening the legislative work of local people’s congresses,this "up and down" regulation model will eventually improve the legislative level of the network car regulation;secondly,the law enforcement supervision proposes to reform the licensing operation system,retaining the platform for the network reservation taxi operation "License",cancel the "Network Appointment Taxi Driver’s License" and "Network Appointment Taxi Transport Certificate",and at the same time explore the establishment of a regulatory model for government-enterprise cooperation;finally,strengthen the autonomy recommendations from strict access qualification review and optimization of the insurance system Improve the complaint feedback mechanism to strengthen platform autonomy in three aspects,and establish industry associations to guide industry self-discipline.The sixth chapter is the conclusion.
