Research On Legal Prevention And Control Of Domestic Violence In China

Domestic violence is a global problem,which greatly endangers social order,family stability and people's physical and mental health.Whether in western countries or in China,there is a dilemma of effective prevention and control of domestic violence.The legal research on domestic violence in China started relatively late,but Chinese legal circles have begun to pay attention to this phenomenon.Nowadays,with the rapid development of modern society,domestic violence has become a very serious social problem in the world.Family violence exposes many problems for itself.It not only causes great harm to women's body and spirit,but also seriously infringes the legitimate rights and interests of the elderly,children and other vulnerable groups.Nowadays,experts,scholars,governments and relevant departments in various countries have been devoting themselves to the study of domestic violence,and have made some achievements.International anti-domestic violence has entered the road of legalization,and many countries have formulated relatively perfect and systematic anti-domestic violence laws and policies.In contrast,the study and prevention of domestic violence in China is still in its infancy,and it is urgent to carry out comprehensive remedies in legislation,justice,economy,society and many other aspects so as to effectively solve this historical legacy and truly realize socialist democracy and civilization.This paper mainly uses three research methods: literature analysis,comparative analysis and layer by layer pushing.Through the comparative study of domestic violence at home and abroad,this paper finds out the shortcomings of domestic violence prevention and control in China and puts forward relevant suggestions.Through reading the relevant literature,we can absorb relevant knowledge and better broaden our thinking,enrich and improve the core ideas of this paper.Based on the legal definition of domestic violence at home and abroad and the current situation of domestic violence,this paper analyses the historical and social causes of domestic violence,and puts forward measures to prevent and improve it.This paper is divided into five main parts,its basic framework and main contents are as follows: The first part,as an introduction,describes the background,significance,research status,research methods and possible innovations of this topic.The second part is an overview of domestic violence.Starting from the legal definition of domestic violence at home and abroad,it analyses the causes,conditions and types of domestic violence.The third part is the extraterritorial status of legal prevention and control of domestic violence,combined with the extraterritorial status of legal prevention and control,put forward the experience of our country for reference.The fourth part is the legal status quo of domestic violence in China.Firstly,it introduces the legal provisions of domestic violence in China.Then it analyses the shortcomings of the current law in dealing with domestic violence,mainly from the legislative,judicial,social and personal perspectives.The fifth part is the prevention and control measures of domestic violence in China,from the legislative system,judicial protection,social supervision,personal awareness of four aspects to prevent and control domestic violence,to comprehensively deal with the problem of domestic violence.
