Research On The Guardianship System Of Adults

In today's society,the problem of population aging is a common problem in all countries of the world.With the improvement of human living standards,the reform of adult guardianship system is imperative in all countries.Our country is a large country in population,so the problem of aging is prominent.We must take action to improve the adult guardianship system.Firstly,the paper analyses the basic concept,nature,general theory of adult guardianship system and its relationship with the system of behavioral competence.On this basis,it analyses the defects of the current adult guardianship system in China based on the current legislation and judicial practice of the adult guardianship system.Then it focuses on the comparative analysis of adult guardianship system in representative foreign countries.Starting from the Anglo-American legal system and the civil law system,it studies the legal guardianship system for adults and the intentional guardianship system for adults and puts forward the corresponding reference significance.Finally,we should construct our adult guardianship system and put forward some suggestions and measures from the legislative level.We should subdivide the scope of adult guardians,clarify the contents of adult guardianship system and enrich the protection methods of adults.At the same time,we should strengthen the supervision responsibilities of the state and society,establish a guardianship and supervision system belonging to our country,effectively protect the interests of adults,and play its real role.The General Principles of Civil Law have made great innovations in the system of intentional guardianship for adults,but because of the broad law,it still has not formed a relatively complete system.We should further supplement and improve the adult guardianship system,and truly protect the interests of our adults through this system.
