With the advent of the "Internet +" era,the film industry has a movie online ticketing platform with a three-dimensional operating model,which makes the business entities in the film market face a more complex and competitive environment.After the competition and elimination of the online movie ticketing platform in recent years,the industry has formed an oligopolistic market structure with vertical integration characteristics.In the fiercely competitive background,the online movie ticketing platform pays more attention to the rapid innovation of technology and mechanism.Its purpose is more to consider the platform's own attractiveness to users,in order to create more convenient viewing channels and better for users.Meet the immediate needs of users.However,the self-censorship and early warning measures within the platform are not sufficient,which leads the operators in the industry to use the newly launched technologies and mechanisms to conduct unfair competition behaviors,and various kinds of competition problems appear in the online ticketing platform of the movie.The most prominent one is the “box office fraud behavior” implemented by the film side using the movie online ticketing platform pre-sale mechanism and the refund mechanism.This paper systematically demonstrates the legal nature and particularity of the behavior,and analyzes the shortcomings of the existing laws in regulating the "box office fraud behavior" involving the online ticketing platform of the movie,and further the harm of behavior through case comparison.analysis.Introduce the solution path of the industry online self-regulation of the movie online ticketing platform under the supervision of relevant departments,and propose to establish a comprehensive competition compliance guide.In order to make the online ticketing platform of the movie better consider the ternary elements of the competition protection protection(the interests of other operators,the interests of consumers and the public interest),so that the online ticket sales market and even the entire movie market will be formed.An efficient and fair competitive environment.This article analyzes the legal regulation of the "box office fraud behavior" of the movie online ticketing platform in four parts.The first part,a general description of the "box office fraud behavior" of the movie online ticketing platform.This part discusses the relevant situation of the film online platform "box office fraud" incident,as well as the causal relationship and operational steps of the behavior.The last mention of this behavior is based on the unique strong market power and timeliness inherent in the Internet platform.The second part analyzes the movie online ticketing platform "box office fraud" from the perspective of legal principles.From the beginning,the paper broke into the analysis with the false propaganda clause in the anti-unfair competition law,and introduced the theory of false propaganda behavior.Then through the judgment of similar cases in China,the paper analyzes and demonstrates the legal nature of the behavior,and demonstrates the unique situation of false propaganda and commercial bribery.The third part is about the necessity of regulating the "box office fraud behavior" of the online ticketing platform for movies.The first step is to demonstrate the harmfulness of the act,to legalize it,and to analyze the legal implications of the damage.The second step is to clarify the legitimacy of regulation in conjunction with the accepted standard of business ethics.The third part analyzes the inadequacy of regulation from the four perspectives of the "Anti-Unfair Competition Law","Anti-monopoly Law","Movie Industry Promotion Law" and "Consumer Rights Protection Law".The fourth part puts forward the countermeasures to improve the "box office fraud behavior" of the online movie ticketing platform.This part starts with the countermeasures of countries' box office fraud phenomenon.It is hoped that the market supervision department will drive the platform to construct the compliance guidelines for the movie online ticketing platform,and propose the industry self-regulatory organization to establish the self-regulation of the online movie ticketing platform of China.
