The e-commerce service platform is an e-commerce platform which provides neutral service business for the transaction subjects engaged in overseas purchasing business on the platform.On the e-commerce service platform,the purchasing agent issues the information of purchasing products to attract consumers;the consumers browse overseas products through the e-commerce platform,and select the purchasing agent to sign the purchasing agreement.The e-commerce platfom plays an important role in connecting the purchasing managers and consumers in the network overseas purchasing business,and becomes the important third subject.This paper is divided into four parts:The first part gives an overview of overseas purchasing and e-commerce platforms.The purchasing business is different from the ordinary commodity transaction,including the multi-party subject,and the legal relation between each subject is more complicated.The analysis of the content of the purchasing agent can clarify the definition and process of o、verseas purchasing,and then analyze the legal relationship between the seller,the agent and the consumer in overseas purchasing.Electric business platfom in the network act as purchasing agency business in the way of using the Internet or mobile networks to help both parties or transaction is completed,depending on the content of the electric business platform operation can be carried out on the platform type.However,the e-commerce platform is ultimately defined as a service platform for providing neutral technical services to buyers and co,nsumers.The second part analyzes the possible problems and causes in the e-commerce service platform.Act as purchasing agency business in electric business platform is easy to produce different problems,such as the payment link,most buyers and sellers to choose the electronic payment,electronic payment hides contains risks such as precipitation,divert excess reserves;In the tax collection and administration,the smuggling behavior is frequent,and the difficulty of tax collection and management brings tax problems to our country.In consumer protection,consumers’ right to know,fair trading rights and so on are often affected by different degrees.The cause of these problems lies in the drive of interest,or the imperfection of the system,or the absence of regulation.The third part analyzes the current situation of legal system of e-commerce platform in China and abroad.Doestic regulations on e-commerce platforms are usually scattered in different legal nouns in the form of provisions.The specification of the e-commerce platform is mostly some administrative regulations,which does not rise to the height of law,and the standard of e-commerce platform is limited.Foreign countries and regions that are representative of e-commerce platform norms are the United States and the European Union,in the United States,the united computer information exchange act on the specification of the format contract,the European Union’s exemption of the responsibility of e-commerce platform,these set of rules are worth studying in our country.In addition,South Korea is also worthy of reference from China by giving e-commerce platform responsibility to protect the purchasing of consumers.The fourth part puts forward some suggestions on the legal regulation of some problems arising from the e-commerce platfom.In order to pay the problem,we should strengthen the supervision of the payment enterprise,improve the management of the fund,and clarify the subject of supervision.It should enhance the operability of relevant laws and regulations,train the professional talents of compound tax and improve the customs supervision mode.In order to solve the problem of consumer protection,we should improve the market access mechanism,improve the information disclosure system of purchasing managers,improve the legal system of purchasing product liability,and expand the channels of consumer relief.
