| With the popularization of Internet and the rapid development of e-commerce industry,online shopping is becoming more and more popular.The scope of online shopping is no longer limited to the domestic market,but is aimed at the world’s largest market,which is becoming increasingly popular with overseas purchasing.People are used to the convenience of using the Internet to experience shopping,and overseas purchasing are no stranger to consumers.However,in contrast with the vigorous overseas purchasing agent,the construction of relevant supporting legal system in China lags behind.Although the online shopping mode is an e-commerce model,it has its own characteristics in many aspects,which is especially reflected in the protection of consumer rights.This paper attempts to discuss the protection of consumers’ rights and interests in overseas purchasing,and puts forward some countermeasures for the sustainable healthy development of overseas purchasing agents from the perspective of legal mechanism construction.In addition to the introduction of chapter 1,this paper consists of four parts.The first part is a simple definition and description of the basic legal issues of overseas purchasing and the protection of consumers’ rights and interests abroad.To analyze the legal relationship between consumers and other relevant subjects in overseas purchasing,and put forward the legal basis of protecting the rights and interests of consumers overseas.The second part puts forward the problems of consumer protection in overseas purchasing:(1)the basic rights of consumers are not guaranteed.(2)the manifestation of relief after the loss of consumers’ rights: the difficulty in establishing consumer rights;Consumer proof is difficult;The jurisdiction of the case is controversial;Consumer protection costs and other issues.(3)the imperfect performance of the agency’s supervision system: the supervision of the agent is unclear;The entry system of the purchasing agent is not strict;The standard of purchasing agent’s credit is not unified.In the third part,we can learn from abroad the status of the regulation of overseas purchasing consumer protection,so as to provide some enlightenment for the protection of consumers’ rights and interests abroad.In the fourth part,the author puts forward some Suggestions on the protection ofthe rights and interests of China’s overseas purchasing consumers in view of the problems in the protection of overseas purchasing consumers and foreign experience in protecting the rights and interests of overseas purchasing consumers. |
