| As China’s urbanization process continues to accelerate,there are more and more low-income groups,migrant workers and new employees in urban areas,People’s demand for housing is getting stronger and stronger.However,housing prices through market resource allocation are high.They are deterred.In order to solve the housing difficulties of low-and middle-income families in cities and towns,the government actively develops affordable housing.Since the founding of New China,the government has continuously explored and improved the housing security system and achieved certain results,but there are still many problems.As a kind of innovative design of shared housing in China,the shared property housing system has taken the lead in Huai’an in 2007 and achieved certain results,effectively solving the problems existing in the traditional housing security system,and thus began to study and test this throughout the country.A system The shared property housing is a bottom-up exploration mode.There are normative legal documents with high effectiveness.The concept of shared property housing is not uniform,the qualification of the subject is not clear,the proportion of property rights is unreasonable,and so on.The housing system needs to be improved from both theoretical and practical aspects.Therefore,it is of great significance to study the shared property housing system from the theoretical and practical aspects and provide theoretical support for the improvement of the shared property housing system.In addition to the introduction and conclusion,this article is divided into four parts,about 40,000 words.The first part systematically sorts out the basic theory of the guaranteed shared property housing system.By exploring the background of its supportive shared property housing system,the basic connotation is defined from the three perspectives of basic concepts,attributes and characteristics,and the ownership of the property is shared by the individual co-owners and the ownership of the building is shared.The common part generates the reasonableness of the income.The co-owner’s subject qualification is demonstrated,and the government and low-income groups or “sandwich” groups are identified as co-owners in the shared property housing,and the rights,obligations and responsibilities between the co-owners are analyzed.The second part summarizes the specific regulations on the implementation of the common property housing laws and implementation in some areas of China.China’s traditional affordable housing system has certain defects,the housing security system is imperfect,and the poor connectivity between different housing systems makes some groups excluded from the scope of protection.In order to protect the housing needs of low-income groups in the society,local governments began to try out a joint ownership housing system.This part summarizes and analyzes the normative documents issued by some pilot areas,from the access and exit mechanisms,the exercise of property rights and rights,the land supply mode,housing planning and construction and supervision procedures.The third part,based on the analysis of the operating mechanism of the guaranteed shared property housing system in the second part,puts forward the current problems of the system.Mainly manifested in: the normative legal documents are ineffective,the provisions are not uniform;common period related cost identification problem;the financing mechanism is not perfect;the distribution of property rights is unreasonable;insufficient government management functions.The fourth part puts forward suggestions for perfecting China’s guaranteed shared property housing.In the United Kingdom,the United States,Singapore and other countries in the field of housing security has been very mature,the fundamental reason is that there is a legal system as a basis,improve the financing system as a guarantee,and promote the formation of a sound housing supply system.Therefore,China should focus on improving the following aspects of the shared property housing system: establish a sound legal system of affordable housing;clarify the main body of renovation costs and define the nature of related expenses;Broaden the financing channels for guaranteed shared property housing;Improve government management functions;determine the proportion of reasonable property rights.Through argumentation,this paper defines the subject qualifications,rights,obligations and responsibilities of the co-owners in the guaranteed shared property housing system,and explains the concept and characteristics of the guaranteed shared property housing system.By analyzing the normative documents issued by some pilot cities,this paper studies Different cities have guaranteed the operation mechanism of shared property housing,analyzed the problems existing in the system,and borrowed the useful experience from abroad to put forward suggestions for perfecting China’s affordable common housing system. |
