Research On The Jurisprudence And Practice Of Chinese Affordable Housing

Affordable housing development and improvement of the system is the object of this study. Protection of housing rights theory is an important theoretical support for the housing system, but time is still shallow that China established housing rights as basic human rights to be protected. The protection of housing rights for citizens is lagging behind. In the future, both in theory and system of construction will require further strengthening and improvement. China compared to Western countries after World War II, especially in the last century, 70s or 80s, construction of affordable housing has undergone considerable development and impressive achievements. China should learn from the valuable experience of UK and Sweden, as the earliest and most characteristic representative countries, In addition, Hong Kong and Singapore as representative of the Asian region, the construction of affordable housing is also distinctive, while its development process has many similarities with the situation of our country and therefore has a strong reference.This article is divided into four parts: the content of housing rights; affordable housing and its legal regulation; housing security system comparisons in several countries or regions; the path of affordable housing options.The first part is the content of the housing rights. Through clearly defining the relationship of housing rights and human rights, the housing rights is a fundamental right to life and in the scope of protection of human rights. Analysis on housing rights, property rights and creditor relations, demonstrated the way to achieve the right to housing. Ideological solidarity is an important source of the protection for housing rights. The protection for vulnerable groups in society aid is a main manifestation of social solidarity thinking. Government, society must pay attention to the housing problem, because it is a manifestation of social equity and justice, housing security is an important social security system component.The second part is affordable housing in our country and its legal regulation. The main contradictions of the housing problem reflected among people and between people and the earth. Housing security situation is worrying, the focus of the development process, several outstanding issues and difficulties facing the reality. The analysis on the existing law of protective housing is helpful to clarify the important institutional weaknesses of affordable housing.The third part is housing security system comparisons in several countries or regions. Through the United Kingdom, Sweden, Singapore, Hong Kong introduction of affordable housing system, analyze and summarize the British "common property" system, the Swedish "National Housing Cooperation with the public housing company", "government subsidies", Singapore "public HDB" system, Hong Kong "HOS", "public housing", "sandwich layer scheme," the basic experience for the construction of affordable housing provides an important reference.The fourth part is the path of affordable housing options. Improve the protection of the legal system, a sound legal regulation, elimination of affordable housing in the institutional barriers.
