Research On The Circuit Court System Of The Supreme People’s Court

Comprehensively deepening reform and comprehensively governing the country by law are the national strategies of our country.At present,judicial reform is in full swing.In 2015,the circuit court of the supreme people’s court(hereinafter referred to as the "circuit court")was established for the first time,marking a new stage of China’s judicial reform.Although it is the first time for circuit court to appear in China,the basic-level court has always been playing the role of circuit court in judicial trial.But the circuit court was designed differently from the lower courts.What is a circuit court?Where does it come from?Is it a figment of the imagination?What kind of organization is it?What was its purpose and purpose?What are the features so far?What are the results?What are the problems and what are the potential problems in the future?How to improve these problems?What will the future hold?Based on the author’s problem consciousness,this paper also writes according to the above logic.This article is divided into four parts:The first chapter is an overview of the circuit court system,first of all have a history,explore the historical origin of circuit court system,secondly analyzes the concept of "tour","the court" to introduce the connotation of the circuit court,again,study the properties of the circuit court for an accurate qualitative,finally summarizes four characteristics of the circuit court,are the specific objectives in the region,the specific case shall,strict filing procedure and trial procedure,the objective of diversification.The second chapter analyzes the background reasons and value functions of the circuit court.Firstly,the three main reasons of the circuit court are the localization of justice,the prominent social conflicts and risks,and the failure of the supervision mechanism.Secondly,it explains that the three value functions of circuit court are to restrict local judicial protection,eliminate judicial localization,relieve the pressure of petition,realize judicial convenience,ensure the unification of law application and maintain judicial authority.The third chapter presents three main characteristics of the circuit court operation through the collected data.First,the acceptance of cases and petition coexist;second,the diversion of a large number of letters and visits;third,the effective implementation of case-handling responsibility system and personnel classification management.The fourth chapter analyzes the effect of limiting "judicial localization" in operation,and warns about possible problems in the future,such as the selection and staffing of judges,and puts forward Suggestions on these problems,such as the adjustment of jurisdiction,and plans for the relationship between circuit courts and local cross-administrative district courts.And improve the circuit court judge selection system,combined with the post system to select trial auxiliary personnel,improve the relevant supporting system.The author hopes to put forward his own opinions through the study of the circuit court system of the Supreme Court,so as to make his own contribution.The author believes that under the current national strategy,China’s judicial reform will be more and more deepening,deepening also means optimization,in the allocation of judicial power optimization will certainly bring many benefits to China’s judicial system,to further improve our judicial system.
