Research On The Implementation Of Community Corrections Penalty In Current China

The implementation of community corrections penalty is an implementation measure of non-custodial punishment.It is not only the trend of the development of penal system in the major countries,but also the epitome of penal enforcement and lighter punishment.Since the implementation of the community corrections pilot project began in China in 2003,the laws and regulations have been continuously established and improved.And a series of community corrections system designs have been explored,which has achieved better legal and social effects.In the decisive period of building a well-off society in an all-round way,how to discover and fully explore the role and intrinsic value of the implementation of community corrections penalty and promote the construction of a comprehensive legal system is still an important part of the reform of the judicial system,and the study on the implementation of community corrections penalty also has certain theoretical and practical significance.In terms of content,this thesis firstly sorts out the concepts and basic theories related to the implementation of community correction penalty.And based on this,carries out an analysis of the current status of the implementation of community corrections penally in the entire China and Lixia District in Jinan City,in which the author is working.Then this thesis demonstrates the characteristics of government dominance,penalty punishment and recovery,supervision and education assistance,and uniformity and difference in implementation strategies.At present,the implementation of community corrections penalty in China has poor social acceptance,insufficient implementation ability,low application rate,and lack of effective returning incentives.Through the consideration of the above problems,the concept of the implementation of community correction penalty is obtained.It is still weak of ideas,lack of authorization,lack of perfection,and lack of evaluation.Furthermore,by exploring relevant experiences and practices in the United States,Canada,the United Kingdom,Japan and Taiwan,Hong Kong,Beijing,Shanghai,etc..It is proposed that further improvement of the implementation of community correction penalty.Including strengthen volunteer participation,construction of rules and laws,system construction and innovation of exploration.
