Since the 1980s,China’s economic development and urban construction have flourished at an unimaginable speed thanks to the major policy decisions of reform and opening up and the promotion of science and technology.But at the same time,illegal construction also develops and expands along with this process and becomes a serious social problem,which has seriously hindered the further development of urbanization.Illegal buildings lack planning approval and quality supervision in the construction process,which is disorderly and dangerous.The existence of a large number of illegal buildings seriously restricts the further development of urban construction,which must be properly handled.In the process of handling,not only the illegal buildings should be rectified,but also social contradictions should be avoided.At present,our country has not yet been against illegal building special governance law and policy,is only in the other areas of law involves some to for handling illegal structures,such as the compulsory administrative law article 44 simple mentioned can be dismantled for illegal structures,single way,and can not adapt to the illegal building relatively complicated social situation.And illegal construction involves many laws and regulations,not systematic,poor enforceability.In the field of administrative law enforcement,many functional departments have the phenomenon of overlapping authority,and most of them are not willing to take the initiative to govern the overlapping parts,which is likely to result in lazy administration and idle administration.This paper analyzes the concept and nature of illegal buildings in detail.And reference for the advanced countries and regions outside of management experience,combined with the current status of governance and difficulties,puts forward the governance of illegal construction pertinence suggestion measures,hope that in the concrete deal with illegal construction,able to juggle between administrative power and the administrative relative person of efficiency and fairness,instant clear urban construction existing in the development of resistance,and can avoid the waste of social wealth,reasonable maintenance of the relative person’s legitimate rights and interests,avoid intensified social contradictions.At the same time,it is hoped that China’s legal system will be more perfect to meet the needs of solving the problem of illegal construction brought by the development of social construction.
