A Study Of The Problems Of Anshan City People's Congress Exercising Legislative Power

Local legislation as an important sector of our socialistic legislation system,is a local legislative power of the local people's congress and its standing committee exercise the power of one of the most important.It is a major measure to comprehensively advance the rule of law and safeguard the enforcement of constitutional law.It is also significant to improve the legislative system,perfect the people's congress system,and propel the people's congress to keep pace with the times.The legislation of municipal people's congress is conducive to the promulgation of more specific local laws and regulations and solution of the hot issues and difficulties in the process of economic and social development according to the actual situations.That the municipal people's congress exercises its legislative power and plays a good leading role is beneficial to building the consciousness of the rule of law,and safeguarding the legitimate rights and interests of the masses.It benefits the promotion of legislation and the improvement of legislation quality,speeding up of the process of rule of law and providing a strong guarantee to propel comprehensively the rule of law in the city.This paper introduced relevant theories of legislative power and local legislative power,and conducted a study on the problems of Anshan city people's congress exercising legislative power.It discovers several existing problems such as the inadequate and passive exercising of legislative power,the stereotype of draft regulations as well as the stereotype of exercising the power of deliberation,etc.The reasons are the imperfect legislative configuration,the constraints of political tradition and the society as well as the insufficient operation mechanism by the nature of legislative power,and so forth.On this basis,this paper,with the hope of providing useful suggestions for Anshan city people's congress to exercise legislative power,proposes specific measures to improve the exercise of legislative power of Anshan city people's congress,for instance,to give full play to the leading role of the people's congress,to build up the political atmosphere and to consolidate the political foundation for Anshan city people's congress to exercise legislative power,as well as to strengthen the team construction of legislative affairs officials by bringing in talents of legislation from higher institution and social think tank.
