People's Jurors Participate In Mediation System To Explore And Research

With the development of the rule of law and judicial reform,the jury system return to public view.Under the influence of the "people's jury system",which was the first trial by the Henan Province Higher people's court,the people's jury system,get higher evaluation.The Ministry of Justice carried out the pilot project which the 50 grassroots courts of the people of the jury system reform to achieve initial results in May 2015.Among them,one of the highlights of the reform pilot work is to involve people's jurors in litigation cases.Along with the "mediation rate" index which put forward in the judicial reform,the grassroots justice to improve the requirements of democracy further.In this paper,through the research on the people's jury system and mediation system history and the social value,the author based on the basis of the existing system,to the mediation system as the starting point,to the people's jury system as a guide.Through theoretical analysis and comparison,the author was thinking for the reform of the feasibility,operability and social the value of the discussion and researching on how to play better in democratic effect and guarantee system of mediation with the participation of the people's jurors.From the perspective of theory and pilot reform,this paper analyzes how to regulate and construct the mediation system with the participation of people's assessors and the value of the system,so as to provide useful help for judicial practice.This article is divided into three parts,and ten sections.The contents are as follows:the first part is an overview of China's people's assessors participating in the mediation system.Divided into three sections,this paper discusses the formation,development,characteristics and significance of the people's assessors participating in the mediation system in china.The second part,the analysis of the current situation of people's assessors participating in the mediation system,is divided into three sections,respectively,discussing the current situation and analysis of the people's jury system and mediation system in China's legislative stage and judicial practice.The third part discuss how to improve the people's juror in the mediation system,divided into four sections:in the first section,establishing the right of people's jury which participate in the legal status of mediation;in the second section,regulating the jury in the mediation of the scope of the case;in the third section,making the security of people's jurors to participate in the mediation of the personnel system;in the fourth section,achieving to participate in the mediation of material security of people's assessors.
