Study On The Legal Measures For The Protection Of Children’s Rights In China

In recent years,China has begun to implement the policy of two births,which means that a large number of newborns will be welcomed in our country.As a social vulnerable group,children are more vulnerable to violations because of their physical and psychological development is not yet sound and lack of self-protection awareness and ability.In order to provide them with a safe and healthy growth environment,we should provide compulsory protection for children’s rights at the legal level,and provide comprehensive protection for children at the national,social,family and school levels.This article is composed of four parts: The first part analyses the theoretical knowledge of children’s rights and the current situation of the protection of children’s rights at home and abroad.This paper expounds the definition of children,the content and characteristics of children’s rights,and summarizes the current situation of children’s rights protection at home and abroad from different levels.It also summarizes the views and achievements of different scholars on children’s rights protection in recent years.The second part analyses the current situation of the legal protection of children’s rights in our country,puts forward the existing problems,and expounds the reasons for this problem.Firstly,the current situation of legal protection of children’s rights in China is described from the aspects of constitution,special law for child protection and related laws.Secondly,it expounds the ambiguity of children’s legal subject status,and analyses the improper relief and placement of abused children in families and schools,as well as the shortcomings of rural compulsory education.Finally,from the legal system,judicial level,administrative measures and system protection,the reasons for the problems in the legal protection of children’s rights in China are analyzed.The third part summarizes the experience of foreign developed countries in the protection of children’s rights and writes the enlightenment to our country.The fourth part,according to the existing problems in the legal protection of children’s rights in China,puts forward the corresponding countermeasures.In terms of legislation,it is proposed to improve the legal system by enacting a law with children as the main body;in the judicial aspect,to improve the judicial protection of children’s rights by expanding the scope of juvenile courts and training professional judicial personnel for children’s cases;and in the administrative aspect,it is suggested to set up special child protection institutions to rationally resettle children in distress and to strengthen legal education and rural education.Administrative measures such as education.
