Study On The Charge Standard Of Civil Litigation Cost In China

The civil litigation system is the core of the judicial system,and as an important part of it-the charging standard for litigation costs,whether it is scientific and reasonable is the key to ensuring the smooth operation of the system.The formulation of the fees for civil litigation fees does not only require a sufficient theoretical basis and respond to the needs of civil justice practice.Therefore,scientifically formulating the scope and proportion of civil fees and realizing the positive value and function of the litigation fee system is the most important task in comprehensively promoting judicial reform and improving the civil litigation system.At present,the legislation on the fees for civil litigation fees is still not perfect.The current Measures for the Payment of Litigation Fees has been difficult to meet the practical needs in the context of the major changes in the current system reform.Based on the basic theory of the civil litigation system,this study analyzes the main problems existing in the judicial practice of the existing civil litigation fees in China.Through the analysis of these drawbacks,under the theoretical basis of the civil litigation fee system guidance,aiming at the construction of a fair and efficient authority judicial system,it proposes a reasonable improvement of the civil litigation fee charging standard system to adapt to the current economic and social development and judicial system reform.need.
