The poverty is a common global problem faced by all countries.Anti-poverty as a very important strategic issue,all countries of the world devote themselves to poverty reduction actively.Since 2013,the targeted poverty alleviation and accurate poverty alleviation proposed by our government are great strategies complying with the trends of precision in international poverty governance in the world,and it became an important part of international undertakings of poverty reduction.In fact,the main contradiction in our country’s society has been transformed into a conflict between the people’s ever-growing needs for a better life and unbalanced development.However,poverty problems will remain widespread and long-lasting.At the same time,with the poverty alleviation entering the final stage of the campaign,all kinds of practical problems are becoming more and more prominent,reducing the accuracy significantly.In addition,the protection of social rights of poor groups is unsatisfactory,making it difficult to achieve stability out of poverty.At present,many localities come up with poverty reduction ordinance,which means that we have made useful explorations in advancing the rule of law in poverty reduction.But the national anti-poverty legislation has been still in the absence state,and the anti-poverty laws or administrative regulations have not been promulgated yet.So it is difficult to provide a solid legal guarantee for accurate poverty alleviation.Therefore,the static legal system must be introduced as soon as possible,which combines precise poverty reduction with national legislation.This process will establish and complete relevant local regulations and rules for accurate poverty alleviation.With the close cooperation of the law enforcement,judicature and law-abiding,we can gradually realize the legalization of poverty governance in China and it does good to the construction of China ruled by law.This article used diversified research methods like comparative research method,literature induction method,empirical research method,normative research method.Strive to reveal that how to use national legislation to help eliminate poverty and achieve accurate poverty reduction.To build a static legal system as the core,improve the self-development ability of the poor,and establish a mechanism for accurate poverty alleviation and long-term development.This article is about legislation of accurate poverty alleviation,focusing on the legislative level and it aims to contribute a little to the process of managing poverty according to law.The article explored the mission and content of national legislation for precision poverty alleviation,in order to promote the development of poverty reduction in China.This article is mainly composed of four parts,expounding the research on the legislation of precision poverty reduction.The first part is an overview of China accurate poverty reduction.First,it starts with several concepts related to precision poverty alleviation,clarifying the concepts of poverty,targeted poverty alleviation and accurate poverty alleviation,and this part analyzes the relationship between targeted poverty alleviation and accurate poverty alleviation.Then,the paper analyzes the theoretical foundation of accurate poverty alleviation from different angles.Finally,the paper summarizes the value of accurate poverty alleviation legislation,and it clarifies the importance and necessity of accurate anti-poverty legislation.The second part analyzes the problems existing in the legislation of accurate poverty reduction in China.In form,the national legislation is absent.And there is an urgent need for the national legislation in the following aspects:protection of the social rights of poor groups,restriction of public power and participation of the social forces in poverty alleviation.So finally we can stably cast off poverty.The third part analyzes the practice of several representative countries in the world about anti-poverty legislation and its enlightenment to China.By combing and comparing the practices of the United States,Britain and Brazil in anti-poverty legislation and practice,we consider the facts of our country,and then learn from the useful experience.The forth part is trying to build the accurate poverty alleviation and legal protection system in China.Aiming at the reality we should learn the legislation practice from foreign countries.It’s urgent for us to accelerate the process of anti-poverty legislation on the poverty alleviation,protect the social rights of poor groups,strengthen power constraints as well as supervision and implement social forces to participate in poverty alleviation.The innovations of this paper include the following two aspects.Firstly,the research perspective of this paper is new,taking the social rights of poor groups as a breach to find the point of convergence between the anti-poverty legislation and the precise poverty alleviation strategy itself,and advocates that the starting point and the foothold of the legislation on precision poverty alleviation is providing legal protection for the social rights of poor groups,which reversing the situation of weakening the social rights of poor groups under the poverty alleviation model of the state’s obligation-based.It encourages the poor to jump out of the circle of rights poverty and achieve true freedom and stable development.Secondly,the research content of this paper is innovative.When analyzing the problems lying in the legislation for precise poverty alleviation,the paper distinguishes between different subjects,and study the rights,powers and obligations of each subject,then analyzes the actual situation of poor groups,governments and social forces in participating in the process of accurate poverty alleviation,which is compatible with the internal system of the poverty alleviation about accurate identification,precise assistance,precise management and accurate assessment.The construction of a precise poverty alleviation legal system enables each subject to achieve positive interaction.Targeted poverty alleviation and accurate poverty alleviation accelerate the development of economy in rural society.However,in fact,there are many phenomena and problems offsetting the achievements of poverty alleviation.Therefore,we should base on protection of social rights of poor groups,and it’s the key to integrate precision poverty alleviation into the rule of law.Then,we must accelerate to build a new pattern of poverty alleviation,besides,it’s important to study and discuss the rights and obligation of all kinds of main bodies about the poverty reduction deeply.We would pay attention to the top-level design of the law,and we need to focus on the empowerment of individual as well,making the precision permeate through every corner of the poverty alleviation.In a word,the essence of the legislation on the accurate poverty alleviation study is the interpretation and expression of anti-poverty practice in the view of law.Legislation must be rooted in rural society in China,and we finally move towards rationalization and modernization of poverty governance.
