Overuse of traditional energy sources has led to increasing environmental pollution. The government requires that China adhere to the clean energy use model.Green mountains and green water are also more important than money. Therefore, the transformation of energy use patterns must be carried out.China has paid more and more attention to the development of clean energy in recent years, nuclear energy will be expanded for use due to it’s cleanliness, efficiency and stability. The number of nuclear power stations and reactors in China is increasing, nuclear spent fuel volume gradually increased. Therefore, the rational disposal of nuclear spent fuel will be a matter worth studying.Nuclear spent fuel is highly radioactive and reasonable disposal is essential,it is related to the sustainable development of China’s nuclear power. For example,a nuclear accident in Japan has caused the development of nuclear power in many countries to be affected. Some countries have reduced the pace of development of nuclear power, and some countries have stopped using nuclear power. The development of nuclear power must be based on safety principles.Second, the pursuit of economics, profitability is also very important. The public’s participation in nuclear power also plays a key role in ensuring that the safety of people and property is not compromised.Nuclear power development also needs to adhere to the principle of sustainable development.A perfect system can guarantee the control of dangers. Many countries have done so,such as France, the United States, and Finland.China needs to learn from foreign research experience and improve China’s nuclear waste fuel disposal legal system. This article analyzes the post-processing technical regulations for advanced countries in the development of nuclear power in the world such as Finland, the legal system for nuclear power in France, and the legal system in the United States.I hope to seek a legal reference for China’s nuclear spent fuel disposal, and also put forward recommendations on China’s nuclear spent fuel disposal in different aspects of the law. This article focuses on the analysis of legal issues concerning the disposal of nuclear spent fuel in China and the recommendations for improvement. At the same time,it also outlines China’s overview of nuclear spent fuel disposal.First,in the introduction part, the research background, research significance, research status and research methods of spent nuclear fuel are introduced.Secondly,it discusses the overview of nuclear spent fuel, the status of nuclear spent fuel disposal in China, introduces the characteristics of nuclear spent fuel and the possible harm caused by irrational disposal, and introduces the world progress of nuclear spent fuel reprocessing technology. The importance of post-processing for further disposal of spent nuclear fuel.Third, the problems existing in the study of nuclear spent fuel in China are elaborated, and in the fourth part,it is illustrated how China’s nuclear waste fuel disposal should improve its legal system. For example, different levels of legal cooperation in the legal system, uniform standards for spent nuclear fuel regulations, rational allocation of nuclear waste spent on the disposal of the regulatory authorities, discussion of the safety of nuclear spent fuel safety laws, and a sound emergency response system, nuclear spent fuel disposal compensation system Suggestions were made to improve aspects and suggested that China should strengthen the public’s participation in and supervision of nuclear spent fuel disposal.Through legal analysis, this paper points out the flaws in China’s nuclear waste fuel disposal legal system, and puts forward legal perfection proposals, hoping to make up for the shortcomings of the current system.
